NJ Judge Issues Handgun Carry Permit To Plaintiff In SAF Lawsuit

SAF Executive Vice President Alan Gottlieb said today this “clearly indicates that our lawsuit is proper, and we are encouraged to press our case to its conclusion.”

Morris County Superior Court Judge David Ironson announced after a hearing in his courtroom this morning that a permit will be issued to lead plaintiff Jeffrey Muller. His application had languished for six months before Judge Philip Maenza, a defendant in the federal lawsuit, denied the permit without a hearing on the grounds that Muller did not have a “justifiable need.”

Muller had been kidnapped by members of a motorcycle gang who threatened to kill him, in a case of mistaken identity. Several suspects have been arrested in that case, and Muller’s application for a permit had gained support from local and state police.

So a guy gets kidnapped and threatened with death, and it still isn't a good enough cause to get a concealed carry license, some Judge needs to be arrested and tried for denying his constitutional rights and then be put in a cell with the outlaw bikers as bunk mates

New Jersey is a weird place, but some people love it. I don't know why.

FWIW NJ is listed as a may issue state but the reality is that it is almost a no issue state, without going into too much detail, I know for a fact that it is almost impossible for an average citizen to ever get a NJ concealed carry permit.
the issuance of this permit speaks volumes. what is needed is a strong class action lawsuit against the almost blanket denial by the NJ courts of permits in NJ for residents carry their weapons.

I have no words for these 'forked-tongue' politicians in several states. Although gun rights have changes for the better in most places, a few states have their gun laws pretty screwed up. Where's the SCOTUS when you need really need them to read the Constitution?

How about the Judge in the original denial kidnapped by a motorcycle gang with his yellow squirt gun and nothing else for defense.

Reading the Constitution is only half the battle. The other half is being able to comprehend what they just read. A 5th grader could comprehend the 2nd Amendment better than these activist judges and politicians.

The problem here in NJ isn't just the politicians and the judges... it's the citizenry.
The gun ownship in Jersey is only about 12% of the population.
This group includes hunters, collectors, sport/clay shooters, self-defense types and criminals (lots of criminals).
The numbers don't add up to any sort of political power...especially since gun owners here won't work together.
And after generations of propaganda the general population is strongly/ignorantly anti-gun.
In fact, the NJ state Constitution has never given Second Ammendment rights to individuals.
So the only way things will change here in Jersey is if US Supreme Court steps in and forces state officials to change their laws.
BTW, a Newark police officer was killed in a drive-by shooting this past week while ordering a pizza.
He wasn't the intended target. Two others were wounded as well.

I agree that one of the biggest problems in NJ is the lack of a good gun owners group that could put pressure on the politicians, educate the politicians and sheeple and try to get some of the outlandish gun laws changed. How I handled it was to move away. FLA is like heaven for gun enthusiasts, NJ's high cost of living, absurd taxes, over crowding and crazy gun laws are only some of the reasons I and many others have voted with their feet and moved away.

The guy who got the permit was the lead plaintiff in SAF's lawsuit against NJ. The lawsuit is still continuing under the remaining plaintiffs and a decision is expected any time now from the Federal district court.

so you're affirming what I said, it appears the only way for an average citizen to ever get a permit in NJ is to be involved in a massive high profile law suit

The fact that the lead plaintiff now has his permit..... may actually strengthen the case for SAF!! NJ is doing the proverbial "backstroke"!

I agree Joe. It looks like the lawsuit put them on their heels and they gave it to him to get him to back down. When he doesn't though, that's when the real pushing starts.

    Absolutely great diners!!!
Unfortunately not great enough to counter balance the stupid gun laws.
FWIW;ALL politicians in the N.E. (Republican OR Democrat) have the same position on guns.
