Man who resisted police wins Supreme Court case.
LANSING, Mich. - The Michigan Supreme Court says people can resist police officers who unlawfully enter their homes.
In a 5-2 decision, the court ordered that charges be dropped against Angel Moreno Junior, a western Michigan man who was accused of obstructing officers at his home in Holland. The officers were looking for someone and tried to enter the home without a warrant.

he won or did he? The cost of defending the charges will break most of us and they win either way
it's more like guilty until proven incident

I think I see a HUGE lawsuit in the very near future. More than enough money to compensate his legal fees and time.

I was going to say the same, but I certainly won't hold my breath. While the criminal case was decided on these terms, a civil case has an uphill battle when arguing against the LEO's prerogative. It'll be interesting to see what happens.

Very scary thing to have happen as the "Hoodies" here in town yell out "Police" as they home invade you. My fear is that the cops will invade somebody`s home with a wrong address and then get themselves blown away by a legal resident who did nothing wrong except to defend his home and family. It`s happened before.

Wrote a paper on the original case recently. Very unconstitutional, I am happy to see this outcome.

Good decision when police are wrong they should be told so & they should have to pay damages IMO to the victim. Entering someones home/private property illegally is becoming way to common.
As far as Police entering by mistake I believe it should be considered self defense if one is hurt & a crime on their part if they hurt an innocent victim, sorry wrong address doesn't make it right.
