    Antonin Scalia says gun control is heading to Supreme Court

    Conservative Justice Antonin Scalia, decrying America's demonization of guns, is predicting that the parade of new gun control laws, cheered on by President Obama, will hit the Supreme Court soon, possibly settling for ever the types of weapons that can be owned.

    I'm rather frankly of the view they will be much tighter than anyone here believes will happen.
    That is, if they actually take a case. I think it requires 4 of the 5 to agree to take one.

    I don't think the case you posted on concerning "may issue" will end up with much on the subject of limits,
    even if it gets to the SC. Again, I think we might get "shall issue" but with only dicta on limits, which afterall
    are a completely different matter.

    Of course my eyes have cataracts and so probably too my crystal ball, prognostications, guesses, and
    forecasts.

    Again, Congress needs to beat the court to the "limits" matter with a National 2A Protection Act that
    both sides can somehow live with. They need to do it before the courts act as a legislature on this matter.

    There is a sensible middle ground. It is also the high ground. Anyone on the "anything goes" side or anyone on
    the "ban everything side" is going to find out that somewhere in between is where the American people are.
    Better that point be defined by Congress than by the courts.

    Prior SCOTUS opinions upheld the NFA 1935 limits of "unusual and uncommon" weapons. Such as sawed off shotguns and full auto firearms. They also said that it protected arms that supported the militia in term of being efficient and effective. Miller went as far as to indicate it ONLY protected arms that would be used by military. Previous opinions also supported it protected arms "in common use at the time."

    SCOTUS puts much stock in previous opinions. I believe it would be difficult to define the most common arms of our time as unusual or uncommon.

    I think Justice Alito summed it up pretty well after the 2010 decision in favor of the 2A in McDonald vs Chicago.

    The Sc going near any amendment is never good. They are there to interpret laws via the Constitution. All else in this regard is to be dictated by the State Legislature in the State where you live.

    SCOTUS in Heller and McDonald struck down States infringing on 2A with handgun bans and carry bans. That was good.

    Yes, yes, and in the courts eyes the limits they define will be leaving gun rights alone.

    Better that an elected legislature define the boundaries which when passed equate to an infringement on
    a right.

    Where do you think we'll stand a better chance? In a House dominated by folks who at least talk
    the right talk, or in a court where you know, going in, at least 4 will vote for rather stringent limits?

    pro-gun states (regardless of party) or in a court with at least 4 votes for stringent limits a foregone
    conclusion.

    Scalia is a shotgun dude. So he took Kagan hunting, big deal. These are not CC people.
    They are not folks who will look kindly on possession of high cap when the reason given for
    possessing them is effectively to resist the very government they are part of.

    Nope folks, if you are putting your hope in our Supremes, with Alito of NEW JERSEY, Roberts of NEW YORK birth,
    (and a staunch Federalist in the true meaning of the word) you are placing the wrong bet.

    We already lost big with Heller. Most here just don't recognize what actually happened.

    After the Roberts debacle on the Affordable Care Act (Obamacare) I have no faith in this court. Although, better now than when BHO starts appointing justices.

    Oh, and it is my opinion that Roberts will go down in history as perhaps the most self-righteous Chief Justices we have had.
