    Maybe it's just me, but it seems to me that if Staples had to communicate to all these small businesses, however many it was that they rejected, that they would have the information from those small businesses to include in the contest if they were serious about changing the rules. Certainly, if Staples really means what it now says, these small businesses could be included in the current contest.

    I feel like they're blowing sunshine up my skirt hoping we forget about this by the time they run another contest. Who knows if there will even be any future contests.

    After recieving my email that after 18 years and many thousands of dollars I was done with them, they responded to my email with this.

    My local Staples has been in an constant struggle because of a close by Office Max that under cuts the majority of Staples prices. The local Staples has shut downed their copy service and has reduced their computer repair staff to one full time person just in the last month or so.

    Managements decision to discriminate against one group at the time the company is in the process of closing stores to cut costs IMO will hasten the beginning of the end for the company.

    I seldom shop at Staples, Costco sells the majority of the items as Staples at a lower cost.

    Of their support. Clearly, they readjust their sights over profitability, gauging making a political statement isn't worth going down in flames. Good for them.

    But I can't see that the zealot anti-gunners out there have one bit less of their zealotry in them. Staples just wasn't one of them. There are still millions of them out there.

    It'd be interesting to know how these politically-motivated firms would act if it was the 1A at stake, their own ability to speak their own minds, write what they wanted, associate with whom they chose to, etc. My guess is they'd be damned before they would lift a finger to erase the right to do so, no matter how good they might feel at erasing the right of others to do so. IMO, it's a sign of how tasty the pap that everyone's been fed seems to some, as if it were a holiday jam for everyone's toast. If only folks thought just a little bit about what these liberty-haters are really doing. If only.

    Actually, the official rules did mention the forbidden categories. It does not change my opinion that they were discriminating against legal businesses.


    THE STAPLES PUSH It Forward CONtest
    OFFICIAL RULES
    NO PURCHASE NECESSARY TO ENTER OR WIN.

    1.Contest Period: The Staples PUSH It Forward Contest (the “Contest”), which also includes a Voter Sweepstakes (“Voter Sweepstakes”) begins 12:01 a.m. Eastern Time (“ET“) on 5/6/13 and ends 5:00 p.m. ET on 5/31/13 (the “Contest Period”).     3.How to Enter the Contest: During the Contest Period, you (“Entrant”) may access the Contest by visiting www.facebook.com/Staples. From the Staples Fan page, a) click that you “Like” Staples (if you do not already), b) click on the Contest Application (the “Contest Application”), c) complete the on-screen registration form including your answer to what a $50,000 digital marketing “push” from Staples would do or mean to your small business (in 75 words or less) and a photo depicting your small business (optional) (all components combined constitute the “Entry”). Although photo is an optional portion of the Entry, photo will be included in the voting gallery portion of the Contest.

    Small Business Definition: For purposes of this Contest, a small business is defined as: a privately owned corporation, partnership, LLC or sole proprietorship; a for-profit business; having less than 50 employees; and must not be a franchise. Certain types of businesses are ineligible. Please see the “Entry Guidelines” listed below for ineligible business categories.
    Entry Requirements include: ◦Entry must be no longer than 75 words
    ◦Entry must be in English
    ◦Photos (if applicable) must be no larger than 2MB and in one of the following formats: jpg, gif, png.

    Entries can only be submitted via the Contest Application. Entries that meet the requirements set forth in these Official Rules will be posted to the Contest gallery (“Gallery”), after review by the Administrator.     4.Entry Guidelines: All Entries must adhere to the following Entry Guidelines and these Official Rules of the Contest. Any Entry that does not adhere to these Entry Guidelines or the requirements set forth in these Official Rules is subject to disqualification from the Contest: ◦If the Entrant is not the business owner, all necessary permissions from the owner(s)/operator(s) to enter the business into this Contest must be obtained by the Entrant.
    ◦If applicable, you, as the Entrant, may be featured in the photo.
    ◦If applicable, you may feature additional people in your photo. Each additional person must be a resident of the 48 contiguous U.S., 18 years of age and older as of date of Entry and employed at your small business. Completed Release Forms must be submitted to Sponsor in accordance with these Official Rules or otherwise on request. Photo may include animals or inanimate objects in addition to you and the additional person.
    ◦Entry may not contain any mention of, as determined by Sponsor, in its sole discretion: ◾Content that includes phrases, trademarked material or other third party materials.
    ◾Clothing worn in a photo (if applicable) showing any third party visible logos, drawings, cartoons, phrases, trademarks or other third-party materials.
    ◾The names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission; or look-alikes of celebrities or other public or private figures, living or dead;
    Content that promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message; is obscene or offensive; endorses any form of hate or hate group; ◾Personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses or other identifying information of any person or entity other than you and the small business.
    ◾Material that is inappropriate, indecent (including but not limited to nudity, or pornography), sexually explicit or suggestive; unnecessarily violent, profane, obscene, hateful, tortuous, derogatory of any ethnic, racial, gender, religious, professional or age group, (including using words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation, or socioeconomic group).
    ◾Content which violates any law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination, and false advertising).
    ◾Violence or content that engages in, encourages, advocates, discusses with the intent to commit, or provides instructions for conduct that would constitute a criminal or civil offense or would otherwise violate any federal, state, local or international law or rule.
    ◾The Entry may not contain material or content for which you were compensated or granted any consideration by any other third party.
    ◾Material or content that is, or may reasonably be considered to be, hate speech, whether directed at an individual or group, and whether based upon the race, sex, creed, national origin, religious affiliation, marital status, sexual orientation, gender identity, or language of such individual or group or that is otherwise unlawfully threatening or unlawfully harassing to any individual, partnership, corporation, or political body.
    ◾Content that disparages, slanders or libel persons or organizations associated with Sponsor or any other brands, companies, or individuals.
    ◾Content or materials in which you impersonate another person or entity.


    ◦The following business categories may not be featured in the Entry, including but not limited to: not-for-profit; religious/faith-based; adult entertainment; gambling; liquor sales; firearms/weapons sales; businesses competing with Staples (including but not limited to technology services, copy and print services, office supplies businesses, facilities supplies and services, office furniture, shipping services, mobile phone sales, any other business that Sponsor deems competitive); any illegal business; or national brands. Sponsor also reserves the right to disqualify any business other than those listed above, in its sole discretion.
    ◦Entry may not have been submitted previously in a contest of any kind or previously exhibited or displayed publicly (i.e., disclosed beyond your immediate circle of friends, small business colleagues and family) through any means.
    ◦Any Entry deemed inappropriate or unsuitable, in Sponsor’s sole discretion, will be disqualified. Entries must be suitable for presentation in a public forum, in the sole discretion of the Sponsor.
    ◦Entrants and all submitted Entries must be in keeping with Sponsor's image as determined by Sponsor, in its sole discretion, or Entry will not be posted.
    ◦The Entry may not contain information known by you to be false, inaccurate or misleading. The Entry may not mention Staples.
    ◦The Entry must be your own original, unpublished work and must not contain, incorporate or reference any content that is owned by any third party or entity, would require the consent of any third party or entity in any jurisdiction, or which infringes any third party’s copyright, patent, trademark, trade secret, right of publicity, right of privacy, moral rights, and/or any other applicable personal or proprietary rights including, but not limited to, copyrighted music.
    ◦Any Entry deemed inappropriate or unsuitable, in Sponsor’s sole discretion or does not adhere to these Official Rules of the Contest, will be disqualified.
    5.Public Voting Period During the Contest Period/How to Enter the Voter Sweepstakes (“Voter Sweepstakes”): All Entries will be reviewed for appropriateness and compliance with these Official Rules by the Administrator within 48 business hours from date of receipt of Entry. All eligible Entries (without registration information) will be posted to the gallery on the Contest Application during the Contest Period for viewing/voting by the general public. Once posted, Sponsor reserves the right to remove an Entry, in their sole discretion if they find the Entry violates these Official Rules in any manner. Visitors (“Voter entrant”) will have the opportunity to visit the gallery each day, select their favorite Entry from the gallery, all access to the Contest Application and complete all required fields of the onscreen registration form to submit one (1) vote for their favorite Entry and to receive one (1) entry (“Voter Entry”) into the Voter Sweepstakes. Limit one (1) entry/vote per person per day. Voters must be legal residents of the 48 contiguous U.S., who are 18 years of age or older. Any attempt by the entrant and/or his/her family/friends to vote more than the number of times authorized herein, using any third party proxy voting services, using multiple names or e-mail addresses and/or any other fraudulent mechanism(s), including robotic, automatic, programmed or similar methods, including incentives and sweepstakes for votes not sponsored by Sponsor shall give the Sponsor, in its sole discretion, the right to disqualify the Entrant's Entry. Please note that even if your Entry is listed as a winner or a leader at the close of the Contest Period, you have not yet won a prize. The public vote will determine 20% of Entrant’s final score and Sponsor’s judging score will determine 80% of Entrant’s final score. Normal Internet access and usage charges imposed by voter’s online service will apply and are voters’ sole responsibility. Voter Entries become the property of Sponsor and will not be returned. Sponsor is not responsible for lost, late, misdirected, corrupted, incomplete or damaged Voter Entries. Proof of submission is not proof of receipt by Sponsor.
    6.Determination of the Grand Prize Winners: At the conclusion of the Contest Period, on or about 6/11/13, all Entries (without photo/registration information) will also be judged by a Sponsor-selected panel of judges based on the following judging criteria: Clarity of Message in Entry (how well the entrant explained what a $50,000 digital marketing “push” from Staples would do for his/her small business) (35%); Originality/Creativity (25%); Suitability for Promotional Purposes (20%); Entry Quality (20%). Sponsor will then combine their judging score and the score from the public vote for each Entrant. Sponsor selected Staples executives, in their sole discretion, may make a final recommendation based on the judging criteria before the scores are tabulated. The top three (3) Entries that receive the highest scores after combining the judging score with the public voting score will be deemed the Grand Prize winners. In the event of a tie, the Entry that received the highest score from the judges will be deemed a Grand Prize winner. Decisions of Administrator/Sponsor are final with respect to all matters relating to the Contest.
    7.Voting Sweepstakes Random Drawings: On or about 6/5/13, the Administrator will select the Voter Sweepstakes Prize winner in a random drawing from among all eligible Voter Entries received throughout the Contest Period. The Administrator is an independent judging organization whose decisions are final on all matters related to the drawing. Odds of winning will be dependent upon the number of eligible Voter Entries received throughout the Contest Period.
    8.Prize Notification: Potential Grand Prize winning Entrants will be notified by the Administrator via phone and/or email/overnight mail. The Administrator will make three (3) attempts to contact the potential Grand Prize winning Entrants via phone within 24 hours from the time winner determination is complete (no messages will be left on voice mail/answering machines). If the Administrator is unable to reach a potential winning Entrant within this time frame, he/she will be disqualified and an alternate will be determined. Grand Prize winning Entrants (and the owner/operator of Grand Prize winning company if not the same person as the Entrant) will each be required to sign and return via email or UPS Overnight, an Affidavit of Eligibility (including winning business’ taxpayer ID#), liability/publicity release (except where prohibited by law) and assignment of rights (for Entrant only) (“Affidavit Package”) within three (3) days of notification attempt or prize will be forfeited and alternate winning Entrant may be determined. The potential Voter Sweepstakes Prize winner will be required to sign and return via email or mail, an Affidavit of Eligibility (including winner’s social security number), and liability/publicity release (except where prohibited by law) (“Affidavit”) within seven (7) days of notification attempt or prize will be forfeited and an alternate winner will be selected. Return of Affidavit Package/Affidavit as undeliverable, if any portion of the Affidavit Package or if the Affidavit is not received within the required time period or if a winner is deemed ineligible, winner will be disqualified and an alternate will be determined/selected. Sponsor reserves the right to confirm eligibility of all potential winning businesses/Entrants/Voter entrants and to verify all potential winning businesses/Entrants/Voting entrants before prizes are awarded.
    If a Grand Prize winner is a member of Succeed: Small Business Network, Powered By Staples on LinkedIn, as of 5:00 p.m. ET on 5/31/13 and at time of winner notification, Grand Prize winner will be eligible to receive a Bonus Contest Prize. Sponsor will make final determination on if a Grand Prize winner is eligible for a Bonus Contest Prize. Voter Sweepstakes Prize winner not eligible for Bonus Contest Prize.

    Each Contest Entrant grants to Sponsor a worldwide, royalty-free, perpetual and non-exclusive right and license to use, copy, distribute, reproduce, modify, adapt, edit, translate, publically perform and publically display and create derivative works from and display each submitted Entry, in any media, and with right to use, copy, modify, edit, and create derivative works there from, and agrees to execute documents confirming such right and license at Sponsor’s reasonable request. No information regarding Entries or judging (including views and votes), other than as otherwise set forth in these Official Rules or on the Contest Application listed above, will be disclosed. By entering, you understand that your Entry (or portion thereof) may be posted online, in Sponsor’s sole discretion, to be viewed by members of the general public.

    9.Prizes and Approximate Retail Values (“ARV’s”): Grand Prizes (3—awarded to the small business listed on winning Entry) – Each Grand Prize will consist of: a one (1) hour consultation with small business expert Steve Strauss, $35,000 in digital media customized to meet the needs of the winning small business with an account manager from GannettLocal, a Constant Contact account for one (1) year (including email marketing, EventSpot, social campaigns, surveys, MyLibraryPlus and email archive) and $10,000, awarded in the form of a check, to help offset taxes. The ARV of each Grand Prize is $60,000. Voter Sweepstakes Prize (1) – A Staples Technology package. Package includes a Microsoft Surface Pro 128GB, a Microsoft Surface type cover, a Microsoft Surface mouse and a $300 Staples gift card. The ARV of the Voter Sweepstakes Prize is $1,500. Bonus Contest Prizes (maximum 3) - $5,000, awarded in the form of a check.
    The digital media length of advertising and any applicable times will be determined by GannettLocal account manager and based on local market rates and availability. The specifics of the buy will be determined by Sponsor. The value of the Grand Prize will be treated as income to the winning business and the winner’s business will be responsible for payment and reporting of all applicable federal, state, and local taxes. Sponsor encourages each winning Entrant/Voter entrant to consult his/her tax advisor to determine how winning this prize may affect his/her tax obligations. The consultation with Steve Strauss must be used on the date/time and at a location specified by the Sponsor. In the event the consultation with Steve Strauss becomes unavailable for any reason, all other elements of the Grand Prize will serve as Sponsor’s full obligation to winner.     10.General Rules: By participating in the Contest and Voter Sweepstakes, Entrants/winning companies/Voter entrants agree to be bound by these Official Rules and the decisions of the Administrator/Sponsor (collectively, “Judges”). Judges’ decisions are final on all matters relating to the Contest. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Contest or Voter Sweepstakes materials and the terms and conditions of these Official Rules, the Official Rules shall prevail, govern and control. All Entries/Voter Entries will be declared made by the authorized account holder of the e-mail address submitted at the time of Entry/Voter Entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The Sponsor and its agencies are not responsible for technical, hardware, software or telephone malfunctions or failures of any kind, including any injury or damage to any person’s computer related to or resulting from participating in or experiencing any materials in connection with the Contest, lost, late stolen, misdirected, damaged, incomplete and/or garbled Entries/Voter Entries, votes, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in the Contest or Voter Sweepstakes or by any human error which may occur in the Contest or Voter Sweepstakes. Consequently, Sponsor and its agencies are not liable in the event your Entry, Voter Entry or vote(s) are not captured due to the aforementioned reasons. If, for any reason, the Contest or Voter Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Voter Sweepstakes or Contest Application, Sponsor reserves the right to cancel the Contest or Voter Sweepstakes and determine/select the winning Entrants from Entries/Voter Entries received prior to cancellation in accordance with these Official Rules. You shall be solely responsible for any damages resulting from any infringement of copyrights, trade secret, right of publicity/privacy rights, or other rights, or any other harm resulting from your uploading, posting, or submission of any Entry to any site and you hereby agree to defend and indemnify the Contest Entities against all third party claims arising out of use of your Entry. Sponsor shall have the right but not the obligation to monitor or review Entries or comments posted, uploaded or submitted by entrants or the public and/or any areas of the sites where users communicate with each other, including but not limited to, chat rooms, bulletin boards or other user forums. Once potential winners are confirmed, they may not display publicly their Entry beyond their immediate circle of friends, small business colleagues and family through any means. Sponsor is not in any way responsible for the content of the Entry or any comments provided by the public. You acknowledge that by providing you with the ability to enter and view and distribute user-generated and/or user-submitted content on the website, Sponsor is not undertaking any obligation or liability relating to any such content, including without limitation any liability arising under the laws relating to copyrights, trademarks, rights of publicity, defamation, privacy, obscenity or any other applicable law. However, Sponsor reserves the right to remove or refuse to post any Entry or comment within the Contest Application that it deems, in its sole discretion, to violate these Official Rules or to take such action for any other reason it deems appropriate. In addition to any legal remedies that Sponsor may have for your violation of the Official Rules, Sponsor shall also have the right in its sole discretion to suspend or terminate your access to the Contest Application and the Contest.
    11.Release and Grant of Rights: For the good and valuable consideration of participating in the Contest and having your Entry considered for use by Sponsor in the Contest Application or any of their websites and/or as otherwise detailed below, sufficiency of which, you hereby acknowledge, you and anyone else featured in your Entry (and the owner/operator of the business, if applicable) (collectively, “you/those featured”) hereby grant to Sponsor, its parent companies, affiliates, brands, subsidiaries, successors, licensees and agents and those they may designate from time to time (all of the foregoing, the “Licensed Entities”), a non-exclusive, worldwide, perpetual, irrevocable, fully paid-up, royalty-free, fully sublicenseable and transferable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, transmit, display, and perform such Entry, in whole or in part, in any media, format or technology, whether now known or hereafter discovered, and in any manner including all promotional, advertising, marketing, publicity, and commercial uses and ancillary uses thereof, without any further notice or payment to or permission needed from you (except where prohibited by law). In addition, you/those featured hereby assign to the Sponsor all rights, titles, and interests that you may be deemed to have in any reproduction, product, or derivative work using or incorporating the Entry. You/those featured represent and warrant that: (i) the Entry does not and shall not infringe on any copyright or trademark or any other third-party right nor violate any applicable law or regulation, (ii) you have the right to grant any and all necessary rights and licenses provided herein, including without limitation, all necessary copyright, trademark and other related rights to the Entry, free and clear of all claims and encumbrances without violating the rights of any person or entity, including any right to privacy or publicity. You/those featured waive any right to inspect or approve uses of the Entry or to be compensated for any such uses. Without limitation of the foregoing, in no event will you/those featured be entitled to, and you waive any right to, enjoin, restrain or interfere with use of the Entry or your Personal Content embodied in such Entry as permitted hereunder or the exploitation of any of the Licensed Entities’ rights hereunder. You/those featured further agree to release, defend, indemnify and hold harmless the Licensed Entities from any and all claims that any commercial, advertising, presentation, web content or any other material subsequently produced, presented, and/or prepared by or on behalf of Licensed Entities infringes on your rights as contained in the Entry. You/those featured agree that you shall have no right of approval, no claim to compensation or benefit, and no claim (including, without limitation, claims based upon invasion of privacy, copyright infringement, defamation, or right or publicity) arising out of any use of Entry or Personal Content or any editing, distortion, alteration, optical illusion, or use in partial or composite form, whether or not intentional.
    12.Disputes: The Contest, Voter Sweepstakes and the Official Rules shall be exclusively governed by and construed in accordance with the laws of the Commonwealth of Massachusetts in the United States of America, without regard to conflicts of law provisions. Entrants submit to exclusive personal jurisdiction in Commonwealth of Massachusetts and agree that any dispute shall be brought in the state and federal courts in Commonwealth of Massachusetts. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred; including costs associated with entering the Contest and Voter Sweepstakes, but shall not include attorneys' fees. Entrant hereby waives all rights to claim punitive, incidental, and consequential damages and/or any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. If any provision of these Official Rules is deemed to be invalid or unenforceable, in whole or in part, such provision will be deemed to be modified or restricted to the extent and in the manner necessary to render the same valid and enforceable and these Rules will be construed and enforced to the maximum extent permitted by law as if such provision had been originally incorporated herein as so modified or restricted, or as if such provision had not been originally incorporated herein, as the case may be.
