Kudos to the family for keeping up the pressure. Never should have gone this far. Never should have been any valid accusation of disturbing a darned thing, as all the upset came from the zero-tolerance nannies who dared belief socking it to an 8th grade kid was right and just.
So "Disturbing the peace" was the code used for charges along with obtruction of justice?
The only ones guilty of that are the teachers/ principles, arresting officer and the arraignment judge. All should be held respinsible for this atrocity against his 1st amendment rights.
A guy that I work with said his son wad told to take off a shirt that just had the writing of the 2A on it and the administration of his school asked him to remove it. He told them to quote, "Get bent."
This has led me to the conclusion that these school employees are so anti-american that they think they are in Europe or something.
This case epitomizes the current state of the education system and the fact that school administrators think they are in control of a prison system and not a place of education. They honestly believe that once they step foot on a bus or into a school they are no longer citizens and protected by civil liberties yet are at the mercy of their convoluted beliefs and prisoners of a socialistic government system.
The good thing about this is that now we have ammunition in the form of the all-mighty legal precedent Liberals love to taunt.
The band teacher started this. I see a lot of trumpets in the kids future. I hope the teacher gets a boot in the tuba. I think the school systems shoud mandate an educational process and competency testing for teachers to educate them in understanding civil rights are still civil rights even if its not in their wheelhouse. Go evil black guns!
The average family cannot afford to bring suit. As a past elected town official I witnessed many complaints made to the town, either written or at a town meeting, similar to this one. Many with merit and many without. The majority of complaints of this type are settled out of court with little or no publicity and reduced legal fees and settlement costs to the town.
All cities/towns have a full time attorney(s) and/ or have law firm(s) on contingency contracts that will defend the city/town at any cost to the taxpayers.
The taxpayers will pay no matter the outcome.
Food for thought; the school objects to a t-shirt and will expend whatever expenses necessary to defend their policy, but the display of undergarments is an allowable freedom of expression.
Had the shirt been in support of 1A, nothing would have been said, but exercising 1A supporting the 2A is considered criminal, this is so totally FUBAR. These people are unfit to educate anyone, for they clearly lack an education.

The kid's mom's lawyer is a smart man. He's offering a win-win scenario, hopefully, the opposition is being a good sport about it.

Outstanding. Perhaps this will lead to a new fundamental understanding that these "zero tolerance" policies are detrimental to the process of teaching our kids what they actually need to know in order to survive in our society, and should not be used to indoctrinate them in "feel-good" utopian philosophies. Dare we hope to dream? Nah, probably not going to happen, at least not any time soon, but at least this is one victory in the process. Hopefully more will follow.

I think that being excessively litigious is also a part of the cultural decay of our society. I'm not sure I would be such an enthusiastic supporter of a lawsuit against the school for monetary damages that exceed the costs involved to the family. If I were to sue, I would ask for reimbursement for legal expenses, for a public apology, and for the firing of the school and law enforcement personnel involved. Beyond that, I think this kid is already better off for knowing he can fight the stupidity and win, even if he gets nothing else.

Yes. By "extremely financially painful" I meant this sort of thing, at minimum, holding the individuals subscribing to such policies utterly accountable in all ways possible, not necessarily inflicting pain and punishment (essentially) upon the district and (ultimately) the students themselves when the district becomes incapable of funding itself due to such heavy fines/penalties. Hold the boards accountable, the principals, policy writers, the educators in question who raise the ruckus, etc. If getting nowhere with that sort of thing, then stick it to 'em, as sometimes this is all that's seen as sufficient force to make something happen. If that's what those in power demand in order to hold them accountable, so be it.
Kudos to the young man for standing up for his 1st and 2nd amendment rights. He could have easily gone along with what he was told by either taking off the shirt or turning it inside-out. Instead he challenged misguided authority in a responsible way. I am sure his parents must be proud, that kid is a credit to his family.

This is not a win. This case points out the absurdity of our present school systems policies, administration and teachers. This is not a win, it is a loss because, not only did the school administrators/teacher trample the persons right, the police and the judge added to and supported the farce. Our system is being destroyed by LE and court system for being all to eager to be party to cases such as this.
What if this young father would not have had the means to fight this case? I am sure there would have been a much different outcome.
I don't think there should have been an issue in the first place. This whole thing was blown out of proportion. I hope the family gets what is theirs from this for the problems

In the wake of this offer, I doubt that. Beyond that, he would need two, one for the criminal charges and another for a civil suit. Then the question is, how good are they, especially the criminal defense attorney. And finally, regardless of however strong a case you feel you may have, you are always rolling the dice. When the outcome of that roll is a criminal conviction, it is a serious consideration.
But here is the most important reason for why that would be unlikely... independent of fighting the good fight, any competent criminal defense attorney would advise taking this deal. If they had one, no doubt that would have been his advice. A criminal defense attorney does not care about any potential civil recourse, nor should they. They are just concerned about their client avoiding a conviction... as they should.
This of course presupposes the charges were in fact valid. They were not. Moreover, Honor Student Jared Marcum did not violate any school policy. So to your point, in this case, it is even worse.
