    I just couldn't resist

    Email I sent to the HR department of Metropolitan State College... just because:

    Hello,

    I was thinking of attending Metro State but upon reading your campus policies I had a question.

    I looked for a contact email for the Campus Police but since I couldn't find one so I thought this would be the next best place to find an answer.

    How does your campus reconcile it's weapons policy (banning licensed concealed carry of firearms by both students and employees) with CRS 18-12-214 (which grants a license holder permission to carry in public buildings, except under specific circumstances which your campus does not seem to satisfy)?

    I'd really like to attend school on your campus, but I can't in good conscience support an institution which seems to flaunt the law.

    THAT IS GREAT! I think a good part of us should send similar e-mails to them ^_^. I'm sure they would eventually cave and allow CCW on campus.

    Its not exactly a flaunt of the law... the law also provides for enities to make their own rules for their properties and interests. I'm not sure I would want to be without that.

    If I ran a school or business, I'd be a little peeved if the government told me I had to allow certain things I didnt want to. They already stick their noses where it doesnt belong enough.

    PRIVATE entities and property, yes. Public buildings and institutions... no. Metropolitan State College of Denver is a public institution, it;'s campus is public property and it's buildings are public buildings.

    CRS 18-12-214 states (BOLD added by me):

    (1) (a) A permit to carry a concealed handgun authorizes the permittee to carry a concealed handgun in all areas of the state, except as specifically limited in this section. A permit does not authorize the permittee to use a handgun in a manner that would violate a provision of state law. A local government does not have authority to adopt or enforce an ordinance or resolution that would conflict with any provision of this part 2.

    (b) A peace officer may temporarily disarm a permittee, incident to a lawful stop of the permittee. The peace officer shall return the handgun to the permittee prior to discharging the permittee from the scene.

    (2) A permit issued pursuant to this part 2 does not authorize a person to carry a concealed handgun into a place where the carrying of firearms is prohibited by federal law.

    (3) A permit issued pursuant to this part 2 does not authorize a person to carry a concealed handgun onto the real property, or into any improvements erected thereon, of a public elementary, middle, junior high, or high school; except that: (Colleges, Universities, trade schools, etc not mentioned)

    (a) A permittee may have a handgun on the real property of the public school so long as the handgun remains in his or her vehicle and, if the permittee is not in the vehicle, the handgun is in a compartment within the vehicle and the vehicle is locked.

    (b) A permittee who is employed or retained by contract by a school district as a school security officer may carry a concealed handgun onto the real property, or into any improvement erected thereon, of a public elementary, middle, junior high, or high school while the permittee is on duty.

    (c) A permittee may carry a concealed handgun on undeveloped real property owned by a school district that is used for hunting or other shooting sports.

    (4) A permit issued pursuant to this part 2 does not authorize a person to carry a concealed handgun into a public building at which:

    (a) Security personnel and electronic weapons screening devices are permanently in place at each entrance to the building;

    (b) Security personnel electronically screen each person who enters the building to determine whether the person is carrying a weapon of any kind; and

    (c) Security personnel require each person who is carrying a weapon of any kind to leave the weapon in possession of security personnel while the person is in the building.(Highly unlikely that they have such security at EVERY entrance of EVERY building)


    (5) Nothing in this part 2 shall be construed to limit, restrict, or prohibit in any manner the existing rights of a private property owner, private tenant, private employer, or private business entity.(As mentioned above Metro State is a public institution, not private property)
    Furthermore, the policy prohibits licensed carry on the campus at all, even OUTSIDE, which is clearly not prohibited to a CHL holder even where the proper security is in place in the buildings.

    Metro State is NOT part of the University of Colorado system, which had an opinion written by a past AG that stated they essentially could ignore the law because of their special status. No case based on that opinion has yet been decided by a court.

    Interestingly, policy is for campus police to escort licensed persons off campus and instruct them not to return with the weapon... and report the incident to HR for employees or the student's school (campus has three separate schools on it).

    A few years back a student was 'kicked-out' of CCA (community college of aurora) for carrying. While sitting in a desk his shirt had ridden up and another student noticed it and freaked out.. He said he would love to return but would not attend CCA, due to their policies.

    Thats why you go with a IWB holster and position it at 12 noon...
