    Hmmmm....lotsa legalese to digest.

    At one point (Pp. 43-44?) they seem to accept that they are going to lose and envision some sort of First Amendment-inspired analytical scheme becoming the law.

    Their history is factually incorrect (as already ably pointed out by Kenpo), and I suspect that Heller's lawyers will just ram that down their throat (as will Scalia and Thomas at Oral Argument).

    OTOH, as a professional matter, I admire that they did the best they could with what they had on that point. Of course, if that's the best they've got on it, they gotta know they're on the short end of that stick.

    I hope Heller's lawyers don't succumb to the temptation to devote all their pages to detailed refutation....a more limited history less might be better.
