Brady Center Takes Utah Dealer to Court for Selling Pistol Grip Shotgun to 18 Year Old Mass Shooter

The Brady Center Legal Action Project has taken a new case, representing Carolyn Tuft, a mother whose daughter was killed in a mass shooting at a popular shopping mall in Salt Lake City, Utah. The killer, armed with two high-powered firearms, a backpack full of ammunition, and a bandolier of shotgun shells around his waist, turned the mall into a war zone in a matter of minutes. Five people were killed, and four wounded, including an off-duty police officer.

The lawsuit contends that the gun dealer is liable for the shootings. One of the firearms he sold to the killer was a pistol-grip shotgun, which federal law prohibits from selling to anyone under 21. The killer was 18 at the time.

Humm I didn't think you had to be 21 to buy a pistol grip Shotgun

    Hmm
    Thats because you dont....
Sounds like some typical Brady Campaign bull
it also says the shooter was armed with a S&W .30 Special
looks like a double whammy of misinformation being turned into accusations thanks to the Brady Campaign
Also didnt like the quote from the Seattle Police chief :
As Seattle Police Chief Gil Kerlikowske has said, it (pistol grip shotgun) is “a weapon not designed for
hunting purposes but for hunting people.”
hunting people and self defense are not the same thing

Just checking. I was pretty sure that you didn't have to be 21.

I know in some states i.e. Virginia you have to be 21 to buy what is consider an Assault Weapon under what Virginia classifies an "Assault Weapon" .

Let's hope the dealer files a counter-suit for double the damages requested plus legal fees.

US Supreme Court already ruled, that a manufacturer or dealer cannot be held responsible for the actions of a person who used a gun that they 'legally' purchased. I think the case will be thrown out.

What does "federal" law state on the age? If in fact one has to be 21, I believe a case can be made (or better yet, a jury convinced)

Did anybody ask Sen. McCarthy if she can identify a pistol grip, given a picture of the weapon? (Hint: It's not the shoulder thing that goes up.)

You do NOT need to be 21 to buy a shotgun, pistol gripped or otherwise. This is coming from someone who has sold lots of shotguns.

Until I see pleadings with a court filing stamp on them, I wouldn't worry.

Pistol grip shotguns are still shotguns.

If they file this suit, I hope they know the term "Vexatious Litigation" because that will be #1 on the counterclaim.
