    martial law and ccw

    Just curious, I suppose this is for those of us wearing our tinfoil hats. If for some reason martial law were declared, does doing so overide a ccw legally. I imagine that is such an event were to take place, all right and privledges of lawful gun owners would be suspended until said time (if ever) were lifted. Anyone know?

    I certainly wouldn't rule out the possibility that CCW is suspended in such a setting.

    Martial law is not a scenario you want to be in.

    Regardless of IF martial law invalidates your CCW permit or not is question for the courts to be determined later - after the situation has been resolved.

    For martial law to be declared, the ---- has to hit the fan above and beyond what ordinary civilian resources can handle.

    It is the suspension of the court system and the ordinary administration of life as we know it.

    The validity of your permit will depend on what the court says.

    After the situation is resolved.

    If martial law is declared, it means that the poo poo has already hit the air mover...stay home and go to the food stocks, and ammo storage locker...prepare to defend.

    Missouri passed Katrina law preventing gun confiscations, however I it doesn't say anything about ccw.

    Basically, during Martial Law... they are going to do whatever they want to and deal with the consequences of any Constitutional violations in the courts after the fact, and after regular law an order has been restored.

    Just like during Katrina, they knew they were violating peoples Constitutional rights and civil liberties! They didn't care! They did what they wanted to during an emergency and dealt with it in the courts afterward. And they lost their court battles.

    So, bottom line if Martial Law is ever imposed is to keep your head down and become invisible!

    After Katrina, my brother in law (has a concealed permit from Georgia) answered and ad asking for holders of weapons permits to apply for temporary positions in New Orleans to assist in guarding certain areas.
    They wanted him to guard a hospital , specifically the drug supplies during the confusion.

    I don't know if they actually suspended HB during this time, or if the local government took that opportunity to just take a bunch of guns from citizens.

    After the fact in Katrina, they lost the court battle and were told to give guns back, however New Orleans is demanding proof of ownership of the guns. After all the houses were blown away and all property lost or destroyed, how are these people supposed to come up with this information?
    I wonder if information was taken from folks who lost their guns and is that information stored with the guns?

    IF the "situation" is "resolved" when the New Order is restored.

    Some "situations" can be seized upon (Rahm Immanual's comment about never letting a crisis go to waste) to affect the change they desire. Whether it be swine flu pandemic, economic collapse, whatever...

    Martial law is a federal issue, whereas gun permits are a state issue. Fed beats state like rock beats scissors. Don't go there, you will lose.

    CCW will be the least of your worries in the crisis...

    Whoever it was that said,.. "Keep your head down, become invisible" is the correct thing,. Stand guard and protect yours..

    I will add,. NOW is the time to know who you can depend on and group with.. There is strength in numbers,.. Don't be caught alone when SHTF.......

    Tin foil hats? I don't think the idea of martial law being declared is so far fetched.

    1. Our current President wants a civilian force as strong and well funded as the US military to enforse Homeland Security goals. (Not subject to Posse Comitatus?)

    2. The Government has nationalized and wants to further nationalize parts of the US economy.

    3. Socialistic Healthcare system being pushed on the US population.

    4. A bill being pushed through the congress that would give the current President the ability to "turn off" the internet, thus cutting off communications between opposition groups.

    5. The current President installing a known and self admitted communist as an advisor.

    6. The current President installing a "Diversity Czar" at the FCC most likely to make and end run around any "Fairness Doctrine" uproar.

    The list goes on and on....the future looks somewhat dark to me as far as our rights are concerned. And I for one and watching things very, very closely.

    As true as that might be, I think we all know that things are not supposed to work that way. States should trump Fed whithin their own borders. I think things are heading in that direction now and that is one of the things that scares the hell out of the Federal Government right now.
