You may already be trying to point this out but it's not clear in your post. The Constitution does not grant us rights. We're born with rights. The Constitution spells out what the government may do.
As I understand it, the bill of rights was added to make sure that some of the most important rights are not trampled and if you read it, you'll notice that they are written such that the government "shall not infringe" upon a right that's already there. The controversy is that some folks think that this is the complete list of rights when it is not.
