As a former VA resident and CHP holder, I can attest to that...but open carry IS legal in such places...been there, done that...you might get some looks, but most folks just assume you're a cop and don't bother you about it.

In Florida, if you have a CWL, you can carry concealed in a restaurant that serves alcohol, but you just can't sit in the bar area, from what I've read of the laws here.

YMMV. IANAL.

MI state law:

Quote:
An individual licensed to carry a concealed pistol shall not possess a concealed pistol on their person or motor vehicle while they have any bodily alcohol content (.02 bodily alcohol content [BAC] or above) or a controlled substance.*

Acceptance of a CCW license constitutes implied consent to submit to a chemical test for violations of this law.

A police officer who has probable cause to believe an individual is carrying a concealed pistol and has consumed alcohol may require a chemical test of breath, blood, or urine.

In addition:
Quote:
Individuals licensed to carry a concealed pistol by Michigan or another state are prohibited from carrying a concealed pistol on the following premises:

. . .

A tavern where the primary source of income is the sale of alcoholic liquor by the glass consumed on the premises

. . .

An entertainment facility that the individual knows or should know has a seating capacity of 2,500 or more

. . .

A Casino
So in Michigan I could have a beer/drink at a restaurant, but not so much that my blood-alcohol level goes above .02.

That's pretty low, IMO. One beer might just do it.

I wonder if my local PD would consent to a test, just so I could see?

But in any case, it shouldn't be a matter of how far one can go before one crosses over the line, but it should be a matter of being extra responsible so that the line isn't even approached.

Oh, but to answer your question:

For me, I'll enjoy a beer every now and then. One is sufficient for me to enjoy my meal. I typically wouldn't go beyond that in normal circumstances, much less if I was carrying.

Guns and alcohol....not a good mix. That being said, if you're at dinner and have a beer or two with a meal...probably no big deal. If you're "going out" for a "night"....leave it in the car.

FYI: Flori-DUH has rules about carrying and the types of estabishments you can be in....known as the 51% rule....

Also, when carrying...it's usually best to sit at a table when in a restaurant..... away from the bar.

Bingo. I'm not going to judge someone else for having one (ONE) while carrying, but it's not something I do.

Sure, I have had one beer, but I don't think I've ever taken it beyond that. And by one beer, I don't mean the 64 oz. big boy!

In MO you can't carry in an estabilshment that makes 51%+ of its money from alcohol sales.

I believe you are only in violation of Texas law if you are intoxicated while carrying, per PC46.035.

When I go out to dinner I might or might not have a beer or a glass of wine with my meal.

None
I feel as though we fight hard enough to keep our rights to own and bare arms. We have to put up with enough BS with the anti's. The last thing we need to do is add fuel to the anti's fire by having them read the morning headlines "Man carrying handgun accidentally shoots self while drinking". Man, can you imagine what they would say about that?
For me?
Drinking + driving = NO
Carrying weapon + drinking = NO
Just my opinion. Maybe I cherrish my right too much to loose them over some idiotic thing. I love beer, Lowenbrau, Sam adams, and Guiness extra stout.
Home. No gun, no driving.

I live in michigan & you are not allowed to carry in a bar at all now as far as a restaurant like applebee's that serves alcohol as well, we can carry in there since the primary source of income is not from alcohol. But NO i would not recommend having anything to drink while your dining unfortunately. Check your local laws & be sure of what you can & can not do, but i would advise against drinking anything while carrying. Hope this helps............

I was wondering about this, I did not see any definition or specification. Can you reference the penal code or the law that says this? My understanding was that you could not be under any influence. That is not the same as no alcohol, think about cough medicine, inhalers and the like.
