Here's the Texas definition of intoxicated so we can put this to rest...

49.01. DEFINITIONS. In this chapter:

(2) "Intoxicated" means:
(A) not having the normal use of mental or physical faculties by reason of the introduction of alcohol, a controlled substance, a drug, a dangerous drug, a combination of two or more of those substances, or any other substance into the body; or
(B) having an alcohol concentration of 0.08 or more.

In Tennessee, one cannot carry in a place which serves alcohol for consumption on the premises, bar or restaurant.

I don't go to bars and if I go out to eat it's with my Wife (and perhaps friends, as in other couples) and in restaurants.

I rarely drink at all, but may order 1 beer (tap only) or a glass of wine while having dinner in a restaurant. I may or may not be carrying. It's not a problem either way.

MA and NH both allow you to carry in a restaurant or bar.

If intoxicated and carrying, that is a separate crime in MA and your LTC will be gone for life. Not sure about NH.

There are reasons I don't favor the gray area. I know the laws of my state, but they're so well defined when it comes to alcohol, or places that sell, or places that have consumption on premisis.

Carrying in restaurant with a bar?
Initially I see nothing wrong with this--that's how my state is about it. If you're going to consume---leave it at home, or in the car. Be responsible. We all see the news every day---don't be a headline or statistic. Think before you carry. Don't drink and carry. Matter of fact, distance yourself from friends when you are with them and they are drinking----nothing but trouble--plain and simple. I've seen several threads about this, and you would think common sense dictates what to do, and how to go about doing the right thing. That should be enough in most instances for one to make an educated decision----but yet these threads still persist. Don't mean to ramble, but------in my opinion---most folks should have already answered the question themselves. Posting appears to be somewhat of a reassurance of their stand on the matter one way or the other.

I always carry, never get drunk, and rarely drink alcohol---the last time I had a beer was in March, at the home of a relative in Michigan. So my answer to the first question is "I do", even though I don't make it a habit.

I have never frequented bars and seldom buy a beer with restaurant meals. I don't like to pay $5 for a beer I can buy for $1 at a liquor store. I also like to be stone cold sober for the drive home.

In my state there's no statutory prohibition to entering a bar while armed, just the usual "no packing under the influence".

My opinion is that you should not have one drop of alcohol unless your guns are locked up. If I am carrying and I decide I would like a cold one - too bad. It is against the law in most states to consume & carry. Plus the legal liability just jumped several fold as soon as that first swallow goes down. It is just not worth it for many reasons.

I may have a couple at home and carry. Never out. I've searched all over and haven't found what the law is in Ky. Some are the same as drinking and driving ( blood alcohol level ).

I am in the same state as you and my answer is pretty much the same. I am also usually the one driving and I can't afford to hear "Sir could you please step out of the car" ? If I get a DUI I'm un-employed ASAP.

Same with North Carolina. Even if I could though, I would not mix the two. Not to mention it's illegal to have alcohol in your system when carrying here too. I think NC has some of the most stringent laws =x
