Let's say you are involved in a SD shooting. Do you think it will in any way improve your situation to have been drinking, even one drink? In MN you are allowed to drink a small amount but in my classes I tell my students two things. You don't drink and drive and you don't drink and carry a gun. That's my rule. I have no problem with carrying in bars and restaurants that serve alcohol. That is another issue. I simply say you don't drink any of the alcohol no matter how little.

As was corrected earlier, in Texas, there is no prohibition on drinking while carrying, only on carrying while intoxicated. The definition provided by Kerbouchard below.

Furthermore, you can't carry in an establishment which earns 51% or more of it's income from the sale of alcohol for on-premises consumption of alcohol. The key there is "on-premises consumption". That's why there's no prohibition on carrying in a liquor store. NOTE: This applies only to Texas. YMMV.

To address Zach & Holly's original question, I always carry where legal. I will often have a drink with dinner, but will never become intoxicated. The same applies to driving an automobile. Don't carry while intoxicated, don't drive while intoxicated. If I want to become intoxicated, I'll pick the appropriate time and place and follow the letter of the law.

Bottom line: Know your state and local laws. Know yourself and your limitations. Be legal, be smart, be safe.

I live in Florida...I have...on rare occasions...had a beer with a full meal. Don't see a problem with it...never felt a thing. Couldn't tell you the last time I did it, but I know I have...

Not illegal, not immoral, not dangerous...just a beer with a meal...OMO...yours may vary...

The concealed carry law was amended recently so that one can carry CONCEALED in places that do not sell alcohol for consumption on the premises.
That includes Walmart and gas stations. However, you still cannot OC in those places, and you cannot carry in a restaurant which serves alcohol. We hope to get that changed, but not sure when it will be so.

I took my sister to lunch today and, since carrying where alcohol is served is not allowed, I just left my weapon in the console. If/when the Governor signs the new legislation it will become a non-issue.

As far as consumption is concerned, I have not been over-served in the last 20+yrs, a 12pk would last for months. Now that I carry daily, probably last for yrs or go bad in the bottle.

When I looked up TN law (planning a trip down there) I noticed that they referred to the "building."

That raised a question that you might answer.

If you are in a hotel that serves alcohol for consumption in it's bar or restaurant, does that mean the whole "building" is non-carry? If I come into the lobby, register, go to my room, etc w/o going into the bar or restaurant, would I be in violation?

Do any of the Oregon guys on here know beyond a shadow of a doubt if open carry is legal in Eugene? I cannot get a straight answer out of anyone I ask. Cops tell me different things.
