Well I would first give him the opportunity to to pass out or tap out! My arm around his neck till his air or blood flow stopped and he was out for the count. That not working a 9mm to the head!!

There is not question of if it is a shoot/no shoot there is a life in danger; that is why the PO shot the guy, or that appears in danger (if the child is dead I do not know this as a fact till he is out or dead).

Tap out? This is not a MMA fight. There is no tapping out in real life, especially in this circumstance. If you want to go hand-2-hand and actually choke the BG out, more power to you. However, I think, and this is OMO(and I might be wrong) that you need to have a clear understanding of what fighting for your life or someone else's life actually entails.

I'd shoot someone killing a baby. There's clearly a disparity of force there, and an immediate threat to the kid's life.
