I don't have the book, but, if I remember correctly, I think that is the source of my friends understanding. Anyone have the book who can check it out?

Thanks, Gary. That helps a lot. Do you by chance have a site to that statute?

No, I do not. I was at the Lake County Law Library one afternoon doing some research, and happened upon it. I believe it can be found in Section 760 someplace, but that is just a guess. This was about 6 or so years ago. 'Sorry.

OK, I just Googled it up. I was mistaken - it is found in Section 790, not section 760. Here's a link to the Statute:

Statutes & Constitution :Search Statutes : flsenate.gov

Here it is
Quote:
Abstract: 790.145 Crimes in pharmacies; possession of weapons; penalties. (1) Unless otherwise provided by law, any person who is in possession of a concealed "firearm," as defined in s. 790.001(4), within the premises of a "pharmacy," as defined in chapter 465, is guilty of a felony of the third degree, punishable as provided in s.
However this is for people who do not have a concealed weapons permit. It's just like if you carry a concealed weapon "without" a permit anywhere it's a felony and there would be an additional charge if you do it in a pharmacy.

Most likely very bad info from a well meaning friend or psyco instructor. Either way, wrong.

Here's the rest of that for you "see it to believe it" types. (like me, it seems :))

Quote:
s. 775.082, s. 775.083, or s. 775.084.

(2) The provisions of this section do not apply:

(a) To any law enforcement officer;

(b) To any person employed and authorized by the owner, operator, or manager of a pharmacy to carry a firearm or destructive device on such premises; or

(c) To any person licensed to carry a concealed weapon.

law was probably written back when Florida CCL was issued by the local sheriffs department, and has never been removed from the laws, but instead they added the exception of LEO and CCL holders.

Carry licenses were never issued by SOs in Florida......County Commissions did prior to '87.
