i believe that OC should be a legal option anywhere you have the right to carry, but the law is the law. he was warned once, the next time he should have been arrested, or at the very least, cited and fined.

My how times have changed.

I remember my daddy, always carrying his 44 special or in later years a 357 at 2 O'clock, and he covered it with a short Levi jacket. If he stood perfectly straight the OWB holster did not show, However, when he moved the jacket swaying on a windy day, or when he got in and out of a vehicle, you could easily see the pistol.

He as an P/T Deputy Sheriff and department rules back then was to ware your badge on your belt right next to the pistol, if you where in street clothing, but he never did. Instead it was in his wallet.

Long story short, no one ever called the police saying "man with a gun", but you would have to be blind not to notice it.

Seems to me that part of the problem is that you can't give a moderate penalty for this. The officer didn't want to get the guy in a huge amount of trouble for a relatively minor problem, but had no option to give him a smaller penalty. I'll bet the guy would've paid attention if he got a $200 ticket, and the officer could actually give it without causing the guy to lose his gun rights and such.

I can't fathom than anyone could be so complacent with carrying that, having been dressed down by a police officer, they would accidentally allow the same thing to happen just two hours later. This guy is a full blown idiot who was trying to "show off" and should have his CCH license pulled. He is a walking negative billboard for the rest of us who try and do it right.

I have a CCW permit and carry concealed so the BG doesn't have early warning. But, I have to ask ... If a law forbids open carry why don't the guys with lights on top of their cars get arrested first. The government is supposed to be "civil servants". When they get exempted from their own laws then they have become the masters which should be unconstitutional. The irony is that real crimminals often get off with a slap on the wrist while law-abiding citizens who inadvertently violate a law, with no harm to others, often get the book thrown at them. A law-abiding citizen rant.

I think it was a conscious decision on his part to openly expose himself. So to speak.

I know of no one who carries a gun, after just being dressed down by a LEO for openly flashing their weapon would be caught doing the exact same thing, in the exact same manner just two hours later!

If it happened to me, it would have been an accident that I was flashing in the first place... And I would be spending the rest of the day, checking and rechecking and being extremely cautious, to ensure I wasn't exposing my weapon in the least little way.

Really, the officer should have arrested him on the second offense. Especially since it happened again in less than 2 hours.

That's just plain "Willful!" The guy has a serious lack of maturity!
