JUST FYI, here is a list I compiled of the states which have a "duty to notify if armed" law:

1.Arkansas
2.Louisiana
3.michigan
4.Nebraska
5.North Carolina
6.Ohio
7.Oklahoma
8.South Carolina
9.Texas
10.Utah

Just use this as a helpful guideline. Please be sure to check the relevant state laws before traveling.
Or, memorize them to help win a bet at the gunclub.

Does this count if you have a CCW license but do not have a weapon on you? Just curious as to what your take on this is.

fyi...not in Texas, only have to show license if you are armed

IANAL (nor an LEO), but from a practical standpoint I can't see the relevance or purpose of notifying that you're a CCW holder if you're not armed at the moment. I expect the purpose of the law is to make the LEO immediately aware of the presence of any deadly weapons within reach, to avoid any nasty surprises later on. I'd think they could care less about the piece of paper/plastic in your wallet if you're NOT armed. But I'll leave it to an LEO to chime in and confirm.

In North Carolina when "approached or addressed" by an LEO, a permit holder must immediately notify the LEO that he/she is a permit holder and whether they are armed.

i.e. "Sir, I hold a concealed carry permit from (state of issuance) and I am (or am not) armed."
Then you can say hello.

WARNING: DO NOT SCREW THIS UP in North Carolina. They are SERIOUS about this.

Been following this thread with interest...... raised eyebrows with some of the replies, chuckles at others.

The Op clearly stated he was in West Texas. I've lived in West Texas for 29 years. Some of the replies to this thread clearly are from folks who have never been to West Texas. A major newspaper article many years ago described West Texas as "the Big Empty". It is an open area that stretches as far as the eye can see and the imagination can wonder. When the weatherman says there is a storm coming that is still 100 miles away, you can step out on your porch and watch it's progress.

This vast open ranch and farm country is perfect for smuggling illegal aliens, drugs, and guns. A lot of LE budgets and manpower are dedicated to those activities. A lot of the illegal activities go on in the overnight and early morning hours to avoid contact with LEO's. Many agencies are facing budget crunches and have had to cut back on patrol times and personnel...... and often it's the early morning hours that see very few LEO's on the highway.

Everything I've said above makes vehicles traveling in the early morning hours of interest to LEO's. Often the State Troopers and Officers from other agencies are interested in a vehicle, but have to wait until something happens that gives them legal cause to stop the vehicle. Exceeding the speed limit gives them that right, no matter if it seems a bit harsh to some to be pulled over for less than 10 over.

To say that the Trooper must have been bored at 0200 is an insult to the dedicated Troopers we have here in Texas. To say "Texas stinks" is an insult to many of the Texas posters here on the board.

The Trooper was doing his job, and the OP indicated that the Trooper was courteous in doing so. One should also keep in mind that Troopers stopping vehicles at 0200 are naturally going to be very cautious...... their nearest backup might be 30 minutes away, so they act accordingly. Asking the OP to step away from the car after seeing the big dogs inside is a smart move on the Trooper's part. Creating a distance between himself and the dogs also gives him the space and time needed to eliminate the potential threat from such animals if a vehicle's owner is engaged in criminal activities and might choose to turn the dogs loose on a Trooper out in the middle of nowhere at 0200.

Law enforcement agencies here in Texas and in many other places throughout the country have had to change their procedures and tactics to match the changes in society. To compare Andy of Mayberry with LEO's today is not reality. Today's society has demanded that LE agencies teach and practice Officer Safety first and foremost. I'm sure Sheriff Andy didn't have to worry a lot about things like that in Mayberry.

Like I said at the beginning of my post....... this thread has been interesting reading.

I can respect the Trooper's job and didn't intend disrespect when I expressed surprise at stopping people for 7mph over. Your arguments make perfect sense.

I was stationed in El Paso (Ft. Bliss) in the late 80's and used to drive the I-10/I-20 corridor across the widest part of Texas. Things have probably changed since then because I used to seriously hammer down in those days (ya know: young, dumb and full of... crap) and they tended to leave me lone. I used to peg my speedometer, doing at least 100mph, being the only car on the road most of the time in those parts. I only got pulled over once by an unmarked (and non-obvious) trooper parked on the shoulder who had just written someone up -- he looked like an ordinary motorist who had pulled over, and I didn't realize it was a trooper until I looked over and saw him as I passed. I stood on the brakes and nearly stood the car up on its nose but it was too late. When he pulled me over he said he would have let me go, being military and going home for Christmas leave, but since he clocked me at 83mph AFTER the nose of the car was basically digging into the pavement, he had to write me up. 20 years later I still remember the cost of the ticket ($78) and the name of the magistrate I had to mail the check to (Ida Mae Waddell). He was pretty cool about it though.
