It does say those things. So perhaps it is a little outdated. Either way we are going to have to agree to disagree.

The fact that something is not enumerated in the Bill of Rights does not mean it is not a right.

If you don't get a queasy feeling from these checkpoints you have either got a badge or your a sheep.

I drive through them all the time here in S. Arizona, mostly I don't worry because I am here legally - but - if the cars at the check are blue not the usual green, I turn around.

I am neither, but I have never had a problem with DL checks.

I do have a problem with drunk/drinking/stoned drivers, unlicensed drivers, people that drive like they are the only ones on the road.

And then there are the illegal aliens - I mean undocumented workers ... :)

We see these check points around here fairly often. The area that the seem to concentrate on has several bars within a few miles of each other and a major road connecting them all so I can see why they have these here. Here in OK we are supposed to notify if carrying. The last incindent aside, I have been stopped at one more of these check points while carrying and the two OHP Officers were obviously gun friendly. As soon as I handed them my permit, they asked what I was carrying instead of where it was at, and then proceeded to tell me the best gun store to try for the gun I had been thinking about buying.

I have no problem with a policeman looking for probable cause outside of a bar. Of course people who are a danger need to get got off the road. A fixed checkpoint where they check EVERYONE I have a problem with - where's the probable cause - where's the reason for the stop ?

In most states, if you are checking everyone for a valid DL and/or sobriety, there is no need for further probable cause. I'm not saying it's right or wrong; just that it is what it is.

Just FYI, this is not correct. This page of the Tokyo Police Department lists the penalties for driving under the influence/intoxicated. The penalty is graduated by the level of intoxication/alcohol they find in your system. The penalities and the levels that they consider to be impairment/intoxication are MUCH stricter than the U.S!

From the site:
酒酔い運転 5年以下の懲役又は100万円以下の罰金
酒気帯び運転 3年以下の懲役又は50万円以下の罰金

This says:

"DWI: Up to 5 years in prison and up to a $10,000 fine.
DUI: Up to 3 years in prison and up to a $5,000 fine."

They really lectured us on the new increased penalities when I renewed my Japanese DL last year. There *is* a lifetime suspension that can be levied for repeat offenders/fatal accidents; it is not the standard penalty for a "mere" DUI.
