yea..... maybe the police arn't allowed to have weapons...... kinda like the UK!!
It IS new york after all..........on maybe new jeresy..........oh shoot...... i get those two so mixed up when it comes to gun laws..........

Hmm... Sounds like a "spun" story to me, I'd like to see further details:

Cop who pulled gun on LIRR says he was attacked

An off-duty New York City police officer who was arrested after he allegedly pointed his gun at a group of passengers on a Long Island Rail Road train said he was defending himself from unruly hockey fans "out for blood" who attacked him.

NYPD Officer David Hendrick, 38, of Brentwood, told News 12 Long Island that he identified himself as a police officer and warned a group of LIRR patrons twice to stop harassing other passengers.

MTA police said their initial investigation showed that Hendrick was trying to quiet down hockey fans returning from a New York Rangers game at Madison Square Garden.

"It started out with cursing, disrespecting people, drinking," Hendrick said.

Hendrick gave the group an ultimatum when they ignored him and continued drinking alcohol, smoking and harassing riders: calm down or he would escort them from the Ronkonkoma-bound 9:17 p.m. Sunday train, he said in the interview.

He said he told the group, "You have two choices. Stop the drinking, stop the cursing, stop the smoking, the disrespect by everybody, or I escort you off the train."

A fight then broke out, Hendrick said.

"A rumble ensued. I had my gun on me. They were coming at me. We were fighting, throwing blows . . . I pulled out my gun, pointed it at the subjects. It was two against one. They were out for blood, and that's why I pulled out my gun on the subjects."

MTA and Nassau police arrested Hendrick at the Mineola station, MTA police said.

Hendrick pleaded not guilty Monday in Nassau District Court in Hempstead to second-degree criminal possession of a loaded weapon, a felony, and second-degree menacing, a misdemeanor.

A judge set bond at $2,000 and cash bail at $1,000.

If convicted, Hendrick faces a maximum of 15 years in prison.

Nassau District Court Judge Andrea Phoenix also issued orders of protection for four passengers.

Hendrick's attorney, Stephen Worth of Manhattan, did not return a call for comment. NYPD officials said Hendrick had been suspended without pay.

Hendrick was contrite in the video.

"Unfortunately, it might have not been the best thing to do," he said.


Well now, that sounds MUCH different. Why is he getting the shaft on this then?

Shouldnt he as a LEO be covered under the Federal LEOSA of 2004? Which means the second-degree criminal possession of a loaded weapon charge go's away?
