I dont know the legal definition, but I disagree. To me, burglary is after or during a forced entry into a building. Robbery is taking an item from somebodies person or from their immediate control (like out of their hand). Theft is covertly taking an item from the suroundings, in the presence of the owner or not.

I don't think he should have fired (much less missed) but I hope he is cleared.

Exactly! Shooting at a fleeing thief into a crowded shopping mall is being criminally negligent and an innocent party could have been killed. It breaks one of the rules of firearms safety: Be sure of your target and beyond. If my child was killed or injured because of this guy's negligent actions, I certainly would be raging.

In our state, robbery is defined as taking property or anything of monetary value through violence or a threat of violence, while causing the victim fear.

Another example why you MUST know the laws in your state. You MUST know when you can shoot and when you cannot. Getting caught up in the moment and trying to "Rambo" youself into some sort of urban hero will get you in jail, real quick!
