I was pulled over (many years ago) late at night for speeding and was almost immediately asked to get out of the vehicle. Later the LEO told me the reason for that was to get a quick gauge on how much I had had to drink, he was fishing for drunks . I was not, by the way. It seems probable that might be why this guy was asked to exit the vehicle. Late at night, did something stupid (ran a stop sign), might be a drunk.
As for the rest, DA's do drop cases that don't add up, or they have little to no chance of winning. A call to the DA's office or a trip down to speak to someone at the courthouse before the trial date might be a good idea. Either way, this is going to take up a lot of his time. If it were me I would start by pulling copies of any relevant concealed weapon and knife laws for the area and start building a case so I knew what to tell the DA, or eventually a judge/lawyer. Interesting, if true. |

.In Ohio there are no laws on knifes. You can carry any way CC or OC. There seems to be more to this story though. Is the knife just a folding knife, no law against it ? If it is one of a type that is automatic blade, that is different , there are laws on those. There was no reason for PO to ask the Ranger to get out of the car if he seen a clip on the Rangers belt, had to be something else. Or the PO has no clue of the law and he is dead wron.
There is no blade lenght limit in Ohio. I smell law suit if it went down as the OP said. |

Some other states have blade-length laws for concealed knives. Here is CO, and MI where I go sometimes, 3.5 inches is the limit. So my Endura is illegal, my Delica is OK.
Regarding the concealed weapon bust: if the cop saw it, it obviously wasn't concealed.

"A person is guilty of criminal possession of a weapon in the fourth degree when...He possesses any dagger, dangerous knife, dirk, razor, stiletto, imitation pistol, or any other dangerous or deadly instrument or weapon with intent to use the same unlawfully against another." |

In Michigan, there is NO length requirement for knives. ANY knife that is designed to be used as a weapon (dagger, dirk, etc) or with a double edged blade is illegal regardless of length. Switchblades and other automatic knives are illegal, but assisted opening knives are legal. A hunting knife (single edge) with a blade longer than 3 inches can be legally carried when hunting. It is the INTENT of the user that determines the legality of a knife with a blade that is longer than three inches. You can not carry a blade in excess of 3 inches if the purpose of the knife is to fight with it.
