When you say yes, absolutely, do you mean that it is something you should move on from or something you should pursue in some way?
Again, one of the several reasons I ask is because none of us like LEOS who are the bad apples, that is granted, but of the many responses to your initial post, not many advised you to take that bad apple to the next highest level rather than just chalking it up to a simple traffic stop. If it is precisely as you relate it, it is a real bizarre LEO incident. I myself have never seen one like it. So I wondered how you yourself felt about what you should do now. Was it minor or a major thing to you?

Hi Duisburg,
My recent post was directed at those posts addressing just the "informing the officer" issue. If you read the earlier post I made in this thread that addressed your situation, I believe you acted correctly but were treated unfairly. You still seem a little ouchy on this subject. I hope this eases up for you.

Did you try to verify that the moving van's spedometer was indicating your correct speed? Many moving trucks have govenors that restrict the speed. I rented one that could not exceed 70 mph. That got annoying since some of the states I drove through had 75 mph speed limits. I don't know how the govenors on those vehicles work or how hard it might be to tamper with them. But I wouldn't put it past some people (previous renters) to a tamper with the speedometer to allow it to go faster. You could use a GPS to check its accuracy.
I would definately follow up with the courts to find out if any charges other than speeding are going on your record. If so, than take steps to fight them. I would definately file a complaint. However, since there is question as to willingness to sign the ticket, much of that may get ignored. However, the officer should have given you his badge number and ID when you requested it. Ask that one of this officers superiors review the tape. But don't expect much to happen. If you want to take this matter to the next level, it will cost you. The officer might get reprimanded but probably not fired or charged for this alone. But, keep this in mind. You will spend enough money persueing this to buy at least a half a dozen quality guns and you probably won't get much in return. And all the lawyers say, "Ka-Ching". Good luck. |

There are ways to approach it that would not cost more than three or four dollars, and I don't think he should consult with a lawyer unless it is for free.
Something overlooked is the idea of being handcuffed for a speeding violation after asking officer for info etc. That is highly unusual in itself. It is bizarre and calls for some inquiry for sure. I would not accept that like it was some minor inconvenience. I have had thousands of people either lie to me or hold back the entire truth, so while I am not questioning Duisburg's integrity, everything I say here depends completely on whether his initial narrative is absolutely true. Re consultations, my personal opinion is via phone or in person, consultation without charge, not a problem. Or even resolving it via phone, not a problem, no bill. Got to help out folks when you can and it is not all about money. Far from it. I think he is all set now and knows what to do to get some results.

So you have some options now as to what to do, and should be all set?

Welcome back home, sorry for the crappy reception. When I was reading your original post I just couldn't stop picturing the first half of "First Blood", and then it went to "Deliverance" Glad neither of these happened to you.

Thats really funny, I didn't even think about First Blood! But if that movie were updated to today John Rambo, I think, would be treated like Tim McVay as "homegrown" civilian "terrorism" even though we trained him. Thanks for the laugh though ![]()

Back in 1995 after I retired from the Air Force my father and I took our last fishing trip to Arkansas. That was my last trip there when I discovered they liked to mess with out of staters. I'll never go back and if fact will go out of my way to miss Arkansas. I do knot like crooked troopers. Welcome back to the states. Not a very good reception back to the states. As a retired Air Force MSgt I'm sorry you were treated like that. A few years ago they did a show on 60 Minutes or 20-20 about crooked cops in Arkansas going after out of state people. Sounds like you were their quota for the evening.
