Open Carry Issues & Discussions Discussion regarding open carry in those States where it is legal to do so. This is not a place to debate the virtues of open vs concealed carry.

I did it again, and this time I got gas!

OC'd again yesterday, since the "soft" run went so well, but it wasn't exactly "in public."

Went to the local stop-n-Rob to get gas. Walked in, wearing my Sig on a Fobus, with a light grey shirt behind. You would THINK that at least SOMEONE would notice, but I was watching and nada! This was right around 4-ish, so all the construction guys were coming in, and it was pretty busy. (We don't have a sheep-in-construction-hat smiley, so just imagine I put one here.)

I thought that *maybe* the lady behind the counter noticed briefly, but if anything she seemed to relax. Perhaps she thought no one would rob her while I was obviously standing in line? Perhaps it was my imagination.

I DID notice that my SA was really heightened. Moreso than I would have guessed. Do you find that when you are carrying, suddenly you seem a bit hyper-aware? Maybe I'm just getting used to it.

Anyhow, I had to drive almost to the VA border after getting gas, because Mr. Bunny won some huge thing on an eBay auction, so it was "pickup only" and guess who got the job to go pickup?

Everything else went really smooth, and I was at this stranger dude's house for like 10 minutes, listening to all the stuff about where the manual is. how to change the batter, etc. -- Nothing. --

On the way out to my car, he goes "So...a gun, huh?"

(SOMEONE NOTICED! )

I said "yes, Sir."

And when he asked why, I explained -very gently- "No offense, Sir. I know you told my husband you are a Minister, but *I* am alone and *I* don't know you. I am sure you are a very nice, honorable man. If someone had less than nice or honorable intentions, this is my way to stay safe."

And he nodded approvingly and told me that one of his parishioners carried some "huge gun" in "one of those things by is armpit" and it was very impressive, nobody messed with that guy.

Not exactly what I was aiming for, but hey -- I filled up the car with gas, and drove to some strange guy's home, alone, at the behest of Mr. Bunny, completely without incident.

Definitely confident to OC anywhere now. Woohoo!

Glad to see your enthusiasm for OC in NC. Since you are a resident I know you are aware of just how nebulous NC laws can be. Laws regarding open carry fall into that category. When I was a resident of NC I encountered NO ONE who recommended OC in the state. Here is an example of the kind of trouble that lurks. You OC with your firearm on your right hip completely exposed. An officer approaches you from your left side. You could be potentially accused of concealed carry because the firearm was not visible to the officer as you were approached. Nonsense? You betcha! But that is the nature of NC law. The problem with NC law is it dates to the middle of the next to last century. Enforcement is up to the officer on the spot. Depending upon the officer's attitude and knowledge you may or may not have a problem. A concealed carry permit lets you bypass the legislature's slackness law and enforcement's variability.

I hope that people will eventually get tired of posting misinformation about the common law offense of going armed to the terror of the public. This quote is taken directly from the NC Firearms Laws summary put out by the NC attorney general:

The elements of the offense, according to Farb, who writes the NC crimes books that are used by LEOs and magistrates in the state to determine the elements of the offense are as follows:

-While armed with an unusual or dangerous weapon
-Go about on public highways
-For the purpose of terrorizing others
-In a mannor that causes terror

That is a paraphrase as I don't have the book in front of me, but it is an accurate breakdown of the elements. One has to intend to terrorize others, simply carrying a holstered handgun doesn't make it. Some officers might not like open carry, but it isn't illegal, and the "going armed..." common law offense doesn't apply to simple open carry.

I open carried in Missouri all last summer, Wally-World, Home Depot, Lowes, numerous restaurants and stop-n-robs and the majority of the questions I got from people were “Is that legal, can I do that?” “How do I go about getting my concealed carry permit?” “What do I have to do to buy a pistol?” When people do notice be prepared to be the “gun authority” . As I carried a 1911 style gun (Para-Ordnance P-14) I also got a couple “Mister, did you know the hammer of your gun is cocked back?” Me, “Yes sir that is the way the designer of the gun intended it to be carried and it really is the safest way.”

In Missouri there is no state law concerning open carry, however open carry is the one area of firearms law that cities are allowed to regulate so you need to know the local ordinances of the city/town you are in.

Bunny,

Kudos on your OC. I haven't tried that myself yet. When NC was a Red state it might have been more advisable. Now that it is blue - I don't know. Good for you though.

Thanks. But we live kinda in the sticks. Well, 1/2 suburb. 1/2 sticks. Most of the neighbors are LEO here, and I'd say more than 50% of the rest of 'em keep firearms in the home. It's pretty gun-friendly here so far. Only one major idiot to deal with, and that was a non-issue. The rest of the time has actually --when anyone even noticed-- led to some great discussions and new friendships with people to bring to the range! :)

And I don't know if you've seen my pic yet of me OCing, but I'm about the least terrifying thing you can imagine! LOL. Seriously. Even when I TRY to look mean and scary, I fail miserably.
