It will be interesting to see how the DCPD handles a self-defense shooting with a handgun after this. A bad guy breaks into a house and is shot and killed by the home owner using a handgun. Will they declare it justified, or will they try to make an example of the home owner to discourage others from using their weapons. I've always found that cities, and PDs are very sore losers.

Hey, just so you know... the Illinois State government pretty much stays out of Cook County unless Daley invites/tells them to do something... Chicago is nothing but a bastion of corruption and the State of Illinois isn't going to do a thing about it any time soon.

Although many municipalities and states will try to draw distinction between "keep" and "bear," there is logically no way you can "keep" for the self-defense purposes covered by the SC, without at least having the minimal right "to bear" from the gun store to your home.

Since the right to keep in one's home can not be infringed, it is hard to see how anyone could logically argue that "to bear" is a not a right.

I'm sure the word smiths at city counsels throughout the country will be busy (and well paid) trying to craft a way out of this, but Scalia's word taken logically can only mean that there must be some inherent right "to bear."

Taken as a whole, particularly with his comments on prohibition of possession by felons, mentally ill, and endorsement of some types of gun free zones in special cases, the whole thing will now come down to "shall issue."

A lot of lower courts are going to have to rethink and rethink all manner of prior positions and case law.

This is one of the most important legal decisions I have been waiting on in my lifetime as it insures the right to bear arms to future generations of Americans.
It also doesn't make the election so life or death important because of polarizing questions like this.I am thankful my side came out on top and I am hopeful we continue to use this right wisely.

Nice. It will be interesting to see if this gets incorporated to the states via the 14th, and how lawsuits in Chi, SF, NYC and others proceed.

Actually it will only take 1 SCOTUS replacement by Obama of a Conservative or Kennedy with a liberal Justice (Clinton) to undo all that we have fought for. They choose the issues they take on, and a SCOTUS majority will guarantee that our rights will be under assault by the followers of Soros. If Mccain can replace Ginsburg and/or Stevens with a Strict Constructionist then we can pass common sense opinions that will protect our rights and freedoms, Without having to Bow to Kennedy.

The next fight for our rights in general and 2A specifically is in November.

Maybe incorrect: No state, or government actor, including municipalities, or individual state actors can deny the constitutional rights of citizens under color of law. (Brown v. Board of Ed.) The Supreme Court has the final say on what is and is not constitutionally allowed by law (Marbury v. Madison); and Supreme Court rulings on constitutional issues are the supreme law of the land and are binding on the states (Cooper v. Aaron); hence, even state and city gun laws can be struck down, if the 14th amendment applies and if they are within the narrow scope of this ruling. (ie. effectively a total prohibition on ownership of firearms commonly used for legal self defense purposes).
