One way we need to start killing these stupid bills once and for all is to eliminate the "except for Law Enforcement and Military" provisions that most of these bills have. You will see Police Chiefs screaming bloody murder and killing that baby with their own hands.

I don't know how many have read the bill, but let me give you a couple of facts that may surprise you about it.

1) There is no "except for Law Enforcement and Military" provision in this bill.

2) Because there is no "grandfathering" nor restitution in the bill anyone with unserialized ammo on Jan. 1, 2011 automatically becomes a criminal.

3) According to Trip Pittman (R-Baldwin Co) he was the only member of the committee to express any concern about it during its first reading.

4) Because there is no "grandfathering" nor restitution in the bill it appears to me to be a classic example of an ex post facto law. If I purchased unserialized ammo on or before Dec. 31, 2010 on Jan. 1, 2011 that act which was legal when committed immediately becomes criminal. It there for appears that the bill is in violation of Article 1, Section 9 of the US Constitution and Article 1, Section 22 of the Alabama Constitution which both state that it is illegal to pass ex post facto laws. It is possible that the bill is also in violation of the due process clause of the Fifth Amendment to the US Constitution. Any attorneys who read this please provide an opinion on the ex post facto concern.

The "no-grandfathering" provision was in the Tennessee bill also. These "legislators" (not the term I was originally going to use) all went to a conference somewhere sponsored by the usual suspects and all picked up the same legislation to bring home to their respective state houses.

Well, I just emailed my State Senator respectfully asking him to oppose this bill, and will be calling my State Representative's office on Monday to respectfully ask him to oppose it also if it makes it to the House. And George, thanks for the heads up. I had heard a rumor of this but it turns out it wasn't just a rumor.

It is a pity, but that is how lots of really really bad ideas become law.
The corporations that have something to sell, sell it. They sell it to legislators in the hope that then everyone will have to buy. That's called "making a market."

Ever wonder why you have to **** to get a job? It has a lot less to do with safety and anti-drug vigilance than you think. And a lot more to do with narrow business interests pushing the service they sell--testing-- to make money.

This is the way the Critters work. It keeps them from having to think.
Just attend the nifty lobby "seminar" and you will know all you have to know to make law. :___
