February 1993 — 20-year-old Michael New enlisted in the United States Army and took an oath to defend the constitution of the United States. His Army Recruiter in Texas never mentioned UN command, foreign officers, or wearing the UN uniform. Instead he was told he was joining the US Army, where he became a decorated medic, saving several lives.
He never dreamed that his name would be mentioned in congressional debates, in the White House, on talk radio across the land, becoming a household name in America. What happened to cause this whirlwind?
21 August 1995 — Michael was informed that his unit would be required to wear blue UN headgear, and a UN armband or patch, on a UN deployment to Macedonia. Michael was told the order to wear the UN uniform was lawful, “Because the President says so, therefore it is." But no one provided a legitimate, legal or rational basis for the order. Eventually, a battalion briefing about the deployment offered the justification that, "We wear the U.N. uniform because it looks fabulous."
10 October 1995 — the day his unit was supposed to meet their new foreign commander (from Finland!) in their U.N. uniforms, Michael showed up in his regulation U.S. Army battle dress uniform (BDU)." The other 549 soldiers came to formation wearing a UN emblem on their baby-blue caps and UN patches on their right shoulders! (To those who know how to read a uniform, the right shoulder tells the command authority, the left shoulder is a unit patch. The US flag was moved to the left shoulder. That means nothing to civilians. It means everything to those who believe their nation should be sovereign.)
SPC New was promptly removed from the parade ground, and informed he would be facing a court-martial. He was read his rights. And so began the events that sent shock waves around the country and the world.
January 1996 — SPC New received a Bad Conduct Discharge (BCD) from the Army. But that was not the end. For twenty years New’s attorneys fought to the Supreme Court three different times, only to lose or be turned away. In the end he lost his case, but that was never the important factor — what mattered then (and now) is the issue of national sovereignty!

IMHO those who suggest the military must ALWAYS obey any order, illegal or immoral be hanged, should note this carefully. There are things worse than going to prison - like losing your honor and betraying your country.
We would be wise to also note which POTUS ordered our troops to be placed under foreign command.

American troops have served under foreign operational control in both world wars, various U.N. actions since 1948, NATO, and in the 1991 Persian Gulf war. It is nothing new.
The Constitution that New swore to protect and defend states the President is the Commander in Chief of the army and the Navy of the United States. As such the President has the authority to assign troops as he sees fit. That is the same President of the United States whose orders New swore to obey.
That same Constitution that New swore to protect and defend declares that the judicial power of the United States resides in one Supreme Court and other inferior courts. That Supreme Court has consistently said New was wrong.

I barely remember this. I don't know enough about the case to have an opinion on the rightness or wrongness of his actions but I seem to remember New was given numerous opportunities to comply with his orders. I have to give him props for being willing to take the consequences of his actions.

Sorry Mr. New but I think there are a million better issues to get a BCD over and lots of ways to avoid a BCD.
