    If it was a snub it's possible the shooter only partially opened the cylinder, dumped the rounds without looking, and didn't notice that one round was prevented from falling out by hitting the grip. Crud in the cylinder may also have prevented one round from falling out. Yes, the shooter should still have noticed something like this, but if they were arguing and his attention wasn't on properly handling the gun anything is possible. Humans muck stuff up all the time.

    Once again, the basic rules of gun handling would have prevented this even with a full cylinder... never point a gun at something you don't intend to shoot.

    My favorite test of the 21 foot rule. For those who didn't see the episode, the hole was a grave that had been dug earlier for a dog Danny killed.

    Involuntary manslaughter I get. Criminal negligence I would understand. I really hate "stick-on" charges.

    The crime was pointing a deadly weapon at another. Being in possession of a firearm during that crime is a valid second charge. If he had threatened the victim with a knife, and had the gun in his waistband, the charge would have been as valid. I'm all for laws that enhance the penalty for using a gun/having a gun while committing crimes of violence. It's about time THEY pay for it, not US.

    No, I'm wrong. The first crime was involuntary manslaughter, accomplished by pointing a deadly weapon at another that was still partially loaded. The accidental is a given in the involuntary part...and they charged him knowing it was an accident.
