    California Assembly Bill 5 - Independent contractors beware

    Not gun related, but leave it to California to ruin everything.

    The affect Assembly Bill 5 is already having on working musicians in California, is going to kill the local music scene. Because of AB5, bar and club owners can no longer hire bands as independent contractors. Now they have to have employee status, complete with benefits. Realistically, bar and club owners can't afford to do that. According to one article* I read on this, the bill was pushed through before many folks realized what it was.

    I don't know how it's impacting independent contractors in other fields. Has anyone here on the forum heard or read about AB5?

    I believe it's an unintended consequence. The bill is to force employers to offer healthcare to all Californians. And they don't care what else they ruin! Once before this was a thing here in CA. It ended in the 70's or early 80's. To get around it then, Musicians had to get their benefits through the Union. They also paid a flat rate fee to play copyrighted music. So you were either a house band with employee status, or a Union Musician. When the labor laws changed so that they could not force you to pay a union they became Independent contractors . Now that the state has the votes to force a Socialist Workers policy They are.

    And its not just Musicians. It is aimed at Carpenters, Plumbers, Roofers, Laborers, Farm labor, etc... Next it will include Tech Workers.

    What will have to happen is "management companies" will spring up that will provide indie musicians to venues and events. The musicians will work for the management company, who will take care of the taxes and health insurance and the venues will pay the management company. There are already companies who do this for indie tech workers. I have worked for a few of them.

    The issue, of course is everybody who counts loses. The artists get paid less and the customers pay more. Who wins are the management companies and the state.
