    Colorado Red Flag Bill Update

The Colorado Red Flag bill is having trouble in the Colorado Senate. It's been laid over yet another day as it appears those in favor of passing the terribly written bill do not have the votes necessary. This is a tenuous situation but we remain hopeful it will die on the vine.

The Governor and both houses of the legislature are one party. For them not to get this passed would be beyond huge.

Here's to hoping that it fails. I'm not a big fan of red-flag laws for a number of reasons. I also see them as an end-run around the second amendment to achieve gun confiscation, and to get law enforcement to buy into taking lawful guns from lawful gun owners using gestapo-like tactics of busting down your door at 4 AM, which endangers those doing the raid as well as the homeowner, who, in the sleepy fog of thinking it's a home invasion, levels his gun at some dark figures in the doorway.

Please encourage all of your friends to write their Senators!

There is also a "Recall" Petition circulating on which signators promise to do everything human to recall legislators that vote for these bad bills.

Don't forget we recalled a couple a few years back.

The bill was laid over this afternoon for the third day in a row.

Since yesterday afternoon, the Democratic President of the Senate has gone public that he is a "No" and the Denver Police Union late this afternoon also came out against the bill.

Good luck. Sometimes we view this stuff too regionally. A victory where you're at slows it's progression to where I'm at.

I'm not calling it a victory yet. Lord knows Colorado politics is one heck of a strange and unwieldy beast.

This year's bill is being called an “Emergency Risk Protection Order” or ERPO in an attempt to lose the negative “Red Flag” reputation.

It is also being pushed more than ever as being about suicide prevention. Don't let any of it fool you. The devil is in the details; it's in the 30 pages of bill language. You can read a complete break down of these 30 pages here, as well as watch a video going through the language line by line.

One of the three Senators considered at risk came out today and said she is voting for HB 19-1177 (Kerry Donovan). She is subject to term limits and appears not to care about repercussions, including a likely recall even though she is term limited.

I've argued that rather than no votes we should have been seeking abstentions. One abstention with the Senate President being a no would mean it would not pass.

Today it's been moved to the bottom of the calendar meaning it will be read the third time at the end of the day. If it passes it goes back to the House for concurrence as amended in the Senate. I am hopeful but not optimistic.

Argh. I received an email from a perceived fence sitting senator (Mike Foote, Eastern Boulder County) who was appointed to the Senate. He has said he will be voting yes on this horrible bill.

The bill passed on the third reading 18-17 with one democrat (Garcia) making a calculated move to vote against it knowing it was going to pass anyway.

This is a terrible bill that will now likely become law. The Californization of Colorado continues.
