No problem buying a long gun in NY. Form 4473 and the inevitable instant check and you should be good to go. Depending on local ordanences of course.
buying rifle/shotgun in NY when Ohio resident
Hi all,
I am going to college in upstate NY (not NYC) and I will be living off campus next semester.
Since I won't be on campus and living on my own with no campus security nearby, I am looking into purchasing a shotgun or rifle. How can I buy in NY state if I am a Ohio resident? Is that even possible? Would I have to go to Ohio and buy a gun and transport it to NY? Thanks

Q: From whom may an unlicensed person acquire a firearm under the GCA?
A person may only acquire a firearm within the person’s own State, except that he or she may purchase or otherwise acquire a rifle or shotgun, in person, at a licensee’s premises in any State, provided the sale complies with State laws applicable in the State of sale and the State where the purchaser resides. A person may borrow or rent a firearm in any State for temporary use for lawful sporting purposes.

Remember shops can have a resident only policy even though it isn't the law.

I am a CT Resident and bought a Mossberg 500 with my drivers licence and a phone call in Gander Mountain in NYS and walked out with it.

ccman, was the Gander Mountain you went to in Rochester NY? IS there a waiting period for a background check and everything? Is there a specific piece of law I can quote the store owner if they aren't sure if my Ohio License and passport will suffice?

Wait a minute... most shops operate under the home or adjacent state only rule. I think you might find some resistance buying in NY. As a student, I'm pretty sure you could get a NY I.D., and not have an issue; but dont you have to get a purchase permit too?
If it were me, I'd just buy in Ohio and not worry about the hassle.

Does it matter where he buys it? Is he legally able to keep a rifle or shotgun in the apartment in NY as a non-resident?

Coolfez. The one I went to was in Middletown NY. I asked two different Guys behind the counter to be sure. They both said all we need is a drivers license and fill out the paperwork. They made a phone call to NICS and I was cleared and paid and was on my way. 10 minutes.

Generally, it is unlawful for anyone under the age of 16 to possess any firearm; however, a rifle or shotgun may be possessed by a person between the ages of 12 and 16 who is engaged in supervised target shooting on a range. A minor at least 14 years of age may hunt with any rifle or shotgun, provided he has a valid hunting license and is accompanied by his parent, guardian or other parentally-designated adult who also holds a valid hunting license.

I guess I can always go to town close to the border of ohio so it won't be as long as a drive.

You should have no trouble purchasing a long gun in NY, providing your background checks are fine. There is no waiting period, and you should be good to go after the "Form 4473" phone call.
Pistol permits, on the other hand can take months, and you need to be a resident of NYS.
