We all remember the Department of Interior's rule change allowing concealed carry in National Parks if the relevant state allowed concealed carry, which was nullified by a liberal judge.

The subject legislation was signed by the President and will become law in February. The actual text of the law, obviously altering 50 CFR 27.42, will be published in the Federal Register on or about the effective date.

The only text of the legislation---HR627---I have found online, the "enrolled bill", includes the following quote from section 512. As you can see from the bold text, it is actually better than the defeated DOI rule change because it does not specify that concealed carry is the only form of carry allowed in National Parks.

An online friend I consider an expert thinks the new bill does not allow open carry where legal by state law, but did not supply any proof. So if you have found a more "final" or official copy of the text of HR627 that proves the bill is limited to concealed carry, show me (as they say in Missouri).

"...(b) Protecting the Right of Individuals To Bear arms in Units of the National Park System and the National Wildlife Refuge System- The Secretary of the Interior shall not promulgate or enforce any regulation that prohibits an individual from possessing a firearm including an assembled or functional firearm in any unit of the National Park System or the National Wildlife Refuge System if--
(1) the individual is not otherwise prohibited by law from possessing the firearm; and
(2) the possession of the firearm is in compliance with the law of the State in which the unit of the National Park System or the National Wildlife Refuge System is located."

IANAL but the bold text reads to me that if, for example the park is in VA you can carry concealed with permit or openly without, but if the park is in TX you would be restricted to concealed with permit only.

But again I am not a lawer just some one who can read plain english. I might not be qualified to comment. ;)

BTW -- there is another wrinkle that the antis are pushing.

Does the

mean compliance with the law of the State re: general carry or mean to be compliance with that State's laws on "Parks"?

Also, can the individual State adopt laws applicable to the National Park System or the National Wildlife Refuge System within that State?

INAL. So I'm waiting to see what shakes out.

"kinda" off topic.

But i thought I saw on the news this morning that some nice lady jogging in a state or federal park was attacked and killed by Coyotes?????

anyone else hear this story? Just another reason to carry ALL THE TIME

The victim was a 19 year old Canadian singer/songwriter named Taylor Mitchell. It happened in Nova Scotia.

Statistical improbability. Grim Reaper was lookin' for her. She had a better chance, let me rephrase, Higher Risk of getting attacked and injured/killed by two legged predators. THAT is why people should be allowed to carry.

ON TOPIC -

I'm confused. So right now, what is the law/rule. Can we CC with Permit in applicable parks State law providing or not? I thought this issue was settled late summer.

And WTH does this have to do with Credit Cardholder (topic title)?

The Parks Bill was attached to a Credit Card Bill as a package.
OK that makes sense. I so wish they would do away with that provision.

No. The DOI rule change allowing concealed carry in National Parks was in effect for a few weeks after its implementation, but the Brady Bunch got a judge to enjoin it, so right now carry in parks is not permitted. Carry per state law (concealed or open where legal) in National Parks and National Wildlife Refuges will become legal in February. Maybe my initial post in this thread was not clear on this.

Just got this notification from MegaVote about an upcoming vote:

Expedited CARD Reform for Consumers Act of 2009 - H.R.3639

This House bill would move the date credit card companies would have to comply with new credit card regulations from February 22, 2010 to December 1, 2009.
The feds feel that credit card companies are taking advantage of the extra time to jack peoples rates and close their accounts. So someone proposed changing the date and the vote mentioned above should happen in the next week.

I wonder if this vote will also affect the date that the National Parks Carry portion as well....

Well, it's December now...any news on this? Did the law go into effect or are we still waiting 'till February?

If credit cards were outlawed only outlaws would have credit cards.

dang, this would make my wife an outlaw.

No improvement over the February date.

Not to sound like a pacifist...but just wait till February man...the law is in place. Yeah, it is stupid that we must wait till then, but just let it be.
