Judge offers choice: Join Army or go to jail

LOCKPORT, N.Y. - A judge offered a 20-year-old man facing sentencing an unusual choice: Enlist in the Army or go to jail for up to a year.

Michael Guerra, 20, had pleaded guilty to second-degree criminal contempt, a misdemeanor, after he was accused of violating an order of protection.

At a hearing last week, his attorney told Judge Sara Sheldon Sperrazza that Guerra wanted to join the Army but couldn't if he was on probation. The judge offered Guerra the chance to follow through, but warned that if he didn't enlist within 30 days he would be arrested and sentenced to jail.

Prosecutor Caroline Wojtaszek was doubtful Guerra would actually enlist but said, "maybe they're the only ones who can whip him into shape."

A judge can't order someone to join the Army, but she can decline to impose a sentence if conditions are met, said Guerra's attorney, Matthew P. Pynn. "We do that with misdemeanors all the time," he said.

Guerra had been accused of shoving his girlfriend's friend against a wall and kneeing her in the stomach. Authorities said he was trying to assault his girlfriend and her friend tried to shield her.

Guerra could not be reached for comment. His attorney said he does not have a telephone.

Over the four years I was on active duty, we had a few soldiers come to us from a judge's "recommendation." More often than not, they wound up being good soldiers, but not always. I guess it's like most things...sometimes it works, sometimes it doesn't.

Over the past 3 weeks I've escorted 4 "Soldiers" from confinement to appointments with their TDS lawyers or to hearings... mostly for AWOL, theft and drugs. Tomorrow I get to escort one to his murder trial (do a search for news stories about a Soldier who killed another Soldier in Colorado Springs recently).

We don't WANT this guy, we have enough problems, put him in jail!!

Ahmen.........this is not what we need in the Army.

Besides I can just imagine the
Limp Wristed Blue Stater's crying over how we're giving the "misguided ute's" of America a choice between joining the Army and Jail.:rolleyes:

I don't know about that......seems a perfect candidate to be the modern day equivalent of a Polish mine sweeper in Iraq......"You there, go see if that suspicious object at the side of the road is an IED".

I don't believe I would want to be in an army with this guy...the only courage he has is picking on those weaker than him. Let the "pros" in prison deal with him...

I agree I was proud to be a member of the military for over 20 years. The military is not and should not be a dumping ground for the dregs of our society. Put him where he belongs with the rest of the scum.
