HB 693, our self defense bill, was shot down in flames on Thursday by the Senate Judiciary Committee. The vote was straight Party Line, 7 Democrats against, 5 Republicans for.
This bill would have given us statutory brandishing and no duty to retreat exemptions. These situations continue to exist now, as before, in that vast gray area in the law books, leaving us at the whims of County Attorneys to prosecute or not. Historically, they have rarely, if ever, prosecuted legitimate self defense shootings, so we can hope that common sense will continue to prevail at the county level. It's certainly non-existant in the State Legislature.
Oh, well, there's always the 2007 session. Maybe the Republicans will re-gain control by then.
