The Senate just refused to expand the list of prohibited purchasers, but he's going to unilaterally expand the list anyway in defiance of Congress?

How about some frigging EO's to loosen up the government regs on small businesses? How about ONE, just ONE frigging idea to get the economy moving again!? How about ONE frigging clue about how reckless the government is spending us into debt beyond our wildest ability to pay it back?

The President hasn't a clue how to be Presidential. History will not be kind to this President. The only thing he gave us, Obamacare, is going to bankrupt our country.

I may be mistaken, but I don't think he can ban guns through Executive Order.

Question, for the politically-astute: What is the actual basis for legitimacy of Executive Orders, how far does that "privilege" go, and how far can Congress go to thwart such end-arounds of the law-making responsibility Congress has? If you know specifics on this, by all means respond, as it strongly applies to the risk of such a path occurring.

It is actually quite simple. He cannot make laws with EO's, period. EO's aren't a way for the President to end around congress. However, given the lies and constant breaking of his oath, I have no doubt the President will try and over reach.

Pretty simple, really.

The president is the CEO of the Federal Government. He can issue any "Executive Order" he chooses, but it does not carry the weight of law. The CEO of the company I work for can issue any "Executive Order" he wants, too. If I refuse to obey it, he can fire me, but he can't have me arrested. Same with the President. The problem is, he CAN fire any of his "employees" who disobey him, and keep doing so until he gets someone in the position who will comply with the order (or until he gets impeached, whichever comes first).

the sad fact is this Country is now being run (and has been for years) by Totalitarian Administrative Agencies. Which are Executive Branch. They have become the 4th Branch of Government and ignore the Bill of Rights when they snag you into their web of entrapment (layers and layers of conflicting rules).

You are denied normal due process including but not limited to, presumed guilt so you have to defend your innocence without them demonstrating a legitimate case, running their little game on hearsay evidence, denying your Constitutional Right of a trial by a jury of your peers... where alleged evidence must be introduced and alleged witnesses confronted. But you are only allowed process through their minions of power hungry ego driven tax dodging government employee jerkwads, until you finally get before an Admin Law Judge several years later. The ALJ is in the same department as the investigators. Your final Appeal is before a panel of 3 of these same department ALJ's (who need to protect their budget via cases and personnel). That's it. :hand44:

When you stand up and defend yourself, they will use outrageous intimidation and stall tactics, often pass you off to another Agency for another investigation, and then when you and your attorney 'bust' the individuals for incompetence and/or breaking their own written Admin rules, those individuals are never fired or reprimanded. Heck they probably got an award or promotion. They then pull their power game on the next victim.

I have NO IDEA how citizens allowed this to happen (since FDR as far as I can tell). The Congress creates law, but then turns it over to the Executive Branch. WThell?? Where is THAT in the Constitution?? These Agencies are completely outside the reach of the voter - including powerful Senators & Congressman because of the "Separation of Powers". Why on Earth would Congress write law and then knowingly remove themselves from control over that same law?? Ridiculous!! Regardless if you 'win', you are out thousands and thousands of dollars in attorney fees, legal investigators, and related legal expenses.

I would bet that the majority of citizen/voters/taxpayers are unaware of this just as I used to be. For obvious names, think EPA, ESA, etc. that have decimated the State of Jefferson/OR economy. There are layers of less known Agencies.
And this my friends NEEDS TO BE REVERSED BY ENACTING CORRECTIVE LAWS!

So dicktator chairman hobama could easily enforce rules thru TSA or myriads of other Agencies - and completely mess with legal gun owners until they are broke. :hand1:

The basis of the executive order is that the President is the head of the Executive branch. An executive order can require or prohibit actions of agents of the executive branch of the federal government, but there isn't ant real basis for them influencing anything or anyone outside of that hierarchy.

WASHINGTON -- Congressman Steve Stockman (R-Texas 36) introduced today the “Restore The Constitution Act.” It is the House companion to Sen. Rand Paul’s “Separation of Powers Restoration and Second Amendment Protection Act.” Stockman and Paul are working together on the joint effort.

“Last week I promised to thwart Obama’s unlawful orders, first by seeking to block, overturn and defund any action that violates the Constitution,” said Stockman. “Promise made, promise kept. No matter his intentions, the Constitution flatly prohibits the President from just making up his own laws.”

“The Orders issued by President Obama are not intended to execute laws passed by the Congress. President Obama is abusing his authority to write his own unaccountable laws. Regardless of your position on gun rights, Congress has an obligation to assert its constitutional authority as the only lawful rulemaking body,” said Stockman.

If passed, the Restore The Constitution Act would declare any past, present or future executive action that infringes on the powers and duties of Congress in Article I, Section 8 of the Constitution, or the Second Amendment to the Constitution or that would require the expenditure of federal funds not specifically appropriated for the purpose of executive action, is advisory only and has no force or effect unless enacted by law.

“Executive action” includes any Executive order, memoranda, proclamation or signing statement. Any executive action in violation can be challenged in federal court by any member of the U.S. House or Senate, the highest-ranking official of any state or political subdivision or their designee, or any person deprived of liberty or property by an executive action.

Couldn't agree more. He is focused on shoving his socialist agenda down our throats! The only logical explanation for his actions (at least that I can come up with) is that he really wants the country to financially fail so he can grab even more power and complete the overthrow of capitalism.

Executive orders cannot make law, but they can clarify or further enforce laws put forth by congress.

Don't know how much political capital he wants to spend on this. If he tries to enact rectrictive measures that are essential new laws, he's reaching beyond his powers. The EO will be immediatly challenged. He would have a very difficult row to hoe given that an EO would likely infringe the second amendment (or arguments could be made that it would).
