I realize this may differ from state to state so if anyone knows what the law is for Virginia I would appreciate that insight. My understanding from articles and books I'v read it if you end up using your weapon (assume legitamite self defense) you will lose your weapon for a time as it will be taken by the police as evidence while the investigation is conducted. My question then is, if I am carrying a second handgun as a bug, and the police become aware of it (directly asked if I have any other weapons on me or being patted down while they are figuring out who the good guys and bad guys are) is my bug subject to confiscation as well even if it was not involved in the incident?

I am looking for the data to take into consideration when I do my Risk/Benefit decision loop. Do I risk being without a back up during an incident but am able to continue to exercise my 2A rights when I get home because my bug is still there. For the record, I currently only have one handgun but am saving up my pennies to get another in the future but worry about losing both in one incident if I put all my guns in one place at the same time.

I'm a cop, unless they ask specifically if you have another one dont offer up the info. If they do ask, dont lie. If the seize the 2nd one, most will return it shortly after ruling out it wasn't the one used.

If you shoot anyone even in a good shoot you will probably be taken to the station. At that point tell them you have another gun. Do not make any statements until you call a lawyer.

Its a good idea too, if you've made any mods or upgrades document them and photograph your firearm for your own records. If your weapon gets seized you'll want to make sure they give it back in the same condition. It will also assist LEA if your firearm (God forbid) ever gets stolen.

When I seize weapons, I always handle them with care as if they belong to me. Most Officers do, but you got some just warming a seat.

Never talk to the Police without representation. Be polite and respectful to them as they cuff-n-stuff you. But keep your 'pie hole' shut!

This is not meant to offend Police, or to imply that all of them are against you. Watch the below, through the whole thing. It says everything. And all of the LEO on this Forum should shake their heads 'yep = up and down' and agree.

NOTE: "People are Stupid" as said by the former Naval Investigative Officer/VA Peace Officer who starts to speak at 28 minutes into the video. Send this to your family!

Watch the whole thing and make sure your Law Abiding family members also watch this!

I can't watch the entire thing but... I will say this that's a choice you have to make, and one a honest cop should respect. Some people have with me and that's fine too. Some have choose to talk with me and was sent home with a handshake....and some not so much. I always handle my cases with this mindset, I'd rather let a guilty man walk than put a innocent man in jail. I understand fully that we all don't think the same.

And I would say God Bless you, Sir! You are an exception. I've investigated some really poorly written reports that sent innocent people to jail.

What I would recommend is that you go back to the video for the second half starting about at the 28 minute mark, for the Naval Investigator/VA Policman's - now a lawyer, who confirms everything. Watch the second half first!

Stay safe and God Bless you for protecting those in your area of responsibility (that is not sarcasm - I mean it).

Thanks for the link to the video. I have watched it previously and it does bring up some good points. We could have a whole seperate thread on what if anything you should say to a police officer but that was not really the question posed in this thread. Devil026 has told me that my bug should not become evidence just because it was on me if it was not involved in the incident and that is good news. Does anyone else agree/disagree or have experiences either way? Thanks,

I had posted on something like this before,but,i'm in S.C. and every situation is different.
Back in 05,a girl i've worked with for 12 yrs now,told me a story about her Uncle.He lived in the Conway area.His wife's car was in the shop,and she used her husband's truck to visit a friend.Apparently,the BG'S thought no one was home.He was in the back of the house,and he heard a loud banging noise on his back door.He went to bedroom and got his ruger 44.They kicked the door in,and when they did,he shot one of them,the other bolted.The BG he shot died.
He told the investigator,when they kicked it in he started firing.They did take his gun,his niece told me.She said he did get the gun back.She said it was under a year,but,she couldn't remember exactly,how long they kept it.

If it ever happens to me . I think i would be ill and need to be taken to the hospital . And at some point call for a lawyer.

Good reason to have several guns. If they confiscate one for evidence then go to your safe and get another one out for carry.

The only opinion that matters in this case is the Officer on scene.

I wouldn't take anything out of my safe, that I wouldn't be willing to risk losing in order to save my life. ;-)

If I ever need to use my HK USP to save my life, well...it saved my life! And I have a second USP just like it.:image035:
