"In his direction" from 30 yards at a withdrawing (possible) thief in a residential area is the definition of reckless...and would be hard to defend even here in S. Oregon where we take home defense seriously.

Burglary; the act of entering a structure to commit another crime, typically a theft.

In OUR CCW training, in the state of Ohio: You DO NOT have the right to shoot at people outside to defend property, especially unarmed people in the dark who are not threatening or shooting at you. I am glad that he was not prosecuted or punished, save for a tongue lashing and not a pleasant one for using his gun.

A man here, saw a guy breaking into his car and shot him from inside the house thru the kitchen window. The bullet hit the BG in the head and killed him. He was charged with murder.

His defense was, he was not intending to "hit" the guy, but scare him and the glass actually deflected the bullet, causing it to hit the deceased. He also said he was in fear that he would grab the garage door opener in the car and come into the house.....

He was found not guilty by the jury. We , were all amazed.

Shooting his gun in the air was a stupid move and served no purpose expect landing him in hot water.
Confronting the dirtbag in his car is another discussion.
He would have been just as effective by turning on all the outside lights and making noise while calling 911...or just calling 911 and let the cops approach quietly to catch them. Anything except shooting in the air.:hand1:

Depends on where you live... I live in "suburbia" and it still takes 5-10 minimum to get an officer here... unless we luck out and have one already nearby... (our neighborhood doesn't have a police patrol)

Most car break-ins probably last 1-2 minutes, but I'm not really sure... I can't imagine them sticking around...
